RENSSELAER POLYTECHNIC INSTITUTE - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: REVISIONS TO TECHNICAL SPECIFICATIONS TO ADD EXTENDED SHUTDOWN CONDITION (EPID L-2025-NFA-0005)
Dear Dr. Ji:
By letter dated June 26, 2025 (Agencywide Documents Access and Management System Accession No. ML25188A197), the Rensselaer Polytechnic Institute (RPI) submitted a license amendment request (LAR) for the Critical Experiments Facility. The proposed LAR would add a new section to the facility technical specification (TS), section 6.10 Special Administrative Controls for Extended Shutdown, to account for limited staffing during extended shutdowns.
The proposed LAR also updates TS sections 1.3 Definitions, 4.7 Radiation Monitoring, and 6.1 Organization Structure to incorporate the creation of section 6.10. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this LAR. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the facility.
Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an application for an amendment to a license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.
By letter dated September 12, 2025 (ML25258A016), you requested to withdraw the application from NRC review. The NRC acknowledges your request to withdraw the application. The NRC staff activities on the review have ceased.
The NRC staff notes that its review to date has identified that your application did not provide the following technical information in sufficient detail to enable the NRC staff to complete its detailed review.
