PERRY NUCLEAR POWER PLANT, UNIT NO. 1 - CORRECTION OF THE ISSUANCE DATE OF THE SAFETY EVALUATION FOR THE LICENSE RENEWAL APPLICATION REVIEW ON THE TECHNICAL SPECIFICATION PAGE (EPID NO. L-2023-RNW-0002)

Dear Mr. Brown:

By letter dated July 3, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23184A081), Energy Harbor Nuclear Corporation submitted to the U.S. Nuclear Regulatory Commission (NRC) an application for license renewal of Facility Operating License No. NFP-58 for Perry Nuclear Power Plant (Perry), Unit No. 1, pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. Effective March 1, 2024, the facility operating license for Perry was transferred from Energy Harbor Nuclear Generation LLC (owner) and Energy Harbor Nuclear Corporation (operator) to Energy Harbor Nuclear Generation (owner) and Vistra Operations Company LLC (operator) (package, ML24057A092). Upon completion of this license transfer, Vistra Operations Company, LLC (Vistra or the applicant) assumed responsibility for all licensing actions under NRC review at the time of the transfer and requested that the NRC continue its review of these actions (ML24054A498). Energy Harbor Nuclear Corporation and Vistra further supplemented the license renewal application by letters dated June 27, 2024 (ML24180A010), July 24, 2024 (ML24206A150), August 7, 2024 (ML24220A270), September 5, 2024 (ML24249A123), October 21, 2024 (ML24295A352), November 7, 2024 (ML24312A368),

December 19, 2024 (ML24354A265), January 27, 2025 (ML25027A327) and April 22, 2025 (ML25112A167), respectively.

The NRC staff completed its safety evaluation (SE) of the license renewal of Facility Operating License No. NFP-58 for Perry, Unit 1 on May 29, 2025 (package, ML25231A205), and on July 7, 2025, the NRC staff issued the renewed license (ML25160A130). On August 19, 2025, the staff issued Revision 1, of the SE report (ML25231A221) which impacted the License Renewal Conditions, section, on page 5 of the revised Technical Specifications (TS). When the SE report was issued on May 29, 2025, the revised TS page 5 included the date of May 2025. With the issuance of Revision 1 of the SE, the NRC staff has revised the date to August 2025 to reflect the change. The corrected Perry TS Page 5 is enclosed. Please remove the current page September 19, 2025

Dose to onsite responders (12) Control Room Habitability License Condition Upon implementation of Amendment No. 148 adopting TSTF-448, Revision 3, the determination of control room envelope (CRE) unfiltered air inleakage as required by SR 3.7.3.4 in accordance with TS 5.5.14.c(i), and the assessment of* CRE habitability as required by Specification 5.5.14.c(ii), shall be considered met.

Following implementation:

(a)

The first performance of SR 3.7.3.4, in accordance with Specification 5.5.14.c(i), shall be within the specified Frequency of 6 years, plus the 18-month allowance of SR 3.0.2, as measured from December 2004, the date of the most recent successful tracer gas test as stated in the response to Generic Letter 2003-01 dated May 30, 2006, or within the next 18 months if the time period since the most recent successful tracer gas test is greater than 6 years.

(b)

The first performance of the periodic assessment of CRE habitability, Specification 5.5.14.c(ii); shall be within 3 years, plus the 9-month allowance of SR 3.0.2, as measured from December 2004, the date of the most recent successful tracer gas test as stated in the response to Generic Letter 2003-01 dated May 30, 2006, or within the next 9 months if the time period since the most recent successful tracer gas test is greater than 3 years.

(c)

The first performance of the periodic measurement of outside air intake and exhaust damper leakage, Specification 5.5.14.d, shall be within 24 months, plus the 184 days allowed by SR 3.0.2, as measured from the date of the most recent successful damper leakage test.

(13) License Renewal License Conditions (a) The information in the Updated Final Safety Analysis Report (UFSAR) supplement submitted as required by 10 CFR 54.21(d) and revised during the application review process, and the licensee commitments listed in Appendix A of the Safety Evaluation Report Related to the License Renewal of Perry Nuclear Power Plant, Unit 1 dated August 2025, is collectively the License
