CONCLUSION OF SECTION 106 CONSULTATION AND NOTICE OF AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR DRESDEN NUCLEAR POWER STATION UNITS 2 AND 3, SUBSEQUENT LICENSE RENEWAL (DOCKET NUMBERS: 50-237 AND 50-249)
Dear Chairperson Timothy Rhodd:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed the final supplemental environmental impact statement (SEIS), Supplement 17, Second Renewal, to the Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, NUREG-1437, regarding the subsequent license renewal of Dresden Nuclear Power Station, Units 2 and 3 (DNPS) for an additional 20 years. DNPS is operated by Constellation Energy Generation, LLC (CEG), and is located in Grundy and Will Counties, Illinois. The NRC staff notified your Tribe of the draft EIS publication on May 23, 2025 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML25143A254). In accordance with Title 36 of the Code of Federal Regulations (36 CFR) Section 800.8(c), the NRC staff elected to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under Section 106 of the National Historic Preservation Act (NHPA) of 1966, as amended.
The purpose of this letter is to notify your office of the publication of the final SEIS and to document the NRCs completion of the NHPA Section 106 process as outlined in 36 CFR 800.
The final SEIS evaluated the environmental impacts of the proposed action (renewing the DNPS operating licenses for an additional 20 years of operation) and alternatives to the proposed action. After consultation with the Illinois State Historic Preservation Office, one historic district, the DNPS Unit 1 Historic District, and its nine contributing resources were recorded within the area of potential effects. The proposed action has the potential to affect the DNPS Unit 1 Historic District. However, CEG does not have any planned construction, operation, or maintenance actions across the DNPS that would directly or indirectly impact character-defining features of DNPS Unit 1 and the nine contributing resources. Plant operations and maintenance activities necessary to support the continued operation of DNPS would be limited to previously disturbed areas and would be expected to be similar to current operations.

CEG will update its environmental screening procedures to include the DNPS Unit 1 Historic District and the results of the DNPS architectural survey. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 50.90, should CEG request to amend the DNPS licenses, an application for an amendment to the license must be filed with the NRC. This filing triggers the NRCs licensing process, including the NRC's responsibilities under the NHPA, if applicable. Therefore, should CEG propose a modification of the DNPS facility, including the DNPS Unit 1 Historic District, the NRC staff, consistent with its licensing process, would review the proposed modification at that time to determine whether the action is an undertaking per 36 CFR 800.3. If it is determined to be an undertaking, the NRC would follow NHPA Section 106, including initiating any necessary consultations. Overall, as discussed in the final SEIS, the NRC staff determined that the adverse environmental impacts of the license renewal for DNPS are not so great that preserving the option for energy-planning decisionmakers would be unreasonable. After a review of the proposed action and CEGs procedures, the NRC staff determined that the proposed action would result in No Adverse Effect to historic properties, as defined in 36 CFR 800.5(b).
