STATUS OF RECOMMENDATIONS: AUDIT REPORT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS SECURITY OVERSIGHT OF CATEGORY 1 AND CATEGORY 2 QUANTITIES OF RADIOACTIVE MATERIALS (OIG-24-A-06)
Regarding the audit report of the U.S. Nuclear Regulatory Commissions (NRC) Security, Oversight of Category 1 and Category 2 Quantities of Radioactive Materials (OIG-24-A-06), the Office of Nuclear Material Safety and Safeguards (NMSS) staff have collaborated with the Office of Enforcement to update the Enforcement Policy with Part 37 severity level examples and the Enforcement Manual to specifically reference Part 37 requirements. Federal Register notice
[NRC-2025-0676], Enforcement Policy Materials Security Violation Examples, was published in the Federal Register on August 29, 2025, to provide for public comment on the Part 37 severity level examples in the Enforcement Policy. NMSS staff have determined that the informal guidance (i.e., the memo Retirement of the Materials Security Issues Forum Process, issued January 5, 2018, Agencywide Documents and Management System (ADAMS)
Accession No. ML17318A056 (non-public)) remains an effective tool and does not require updating at this time to capture current enforcement actions for Part 37 violations. The status of the recommendations below remains open: resolved.
Recommendation 1.1: Update NMSS (Nuclear Material Safety and Safeguards) informal guidance, as needed, with up-to-date examples for staff to consistently determine the severity level of Part 37 violations.
Recommendation 1.3: Update the Enforcement Policy and Enforcement Manual to specifically reference Title 10 of the Code of Federal Regulations (10 CFR) Part 37 Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material requirements; include in these updated documents any necessary references to the newly updated informal guidance; and disseminate the updated documents for staff consideration when determining the severity level of Part 37 violations.
