License Amendment Request to Exempt Requirement for a USA The National Enrichment Facility Criticality Accident Alarm System in Planned Centrifuge Storage Building (LAR-25-03)
Pursuant to the requirements of 10 CFR 70.34, Louisiana Energy Services, LLC (LES), dba Urenco USA (UUSA), hereby requests an amendment to Materials License SNM-2010 and in accordance with 10 CFR 70.17, requests to incorporate an exemption to License Condition 33.
This submittal requests an exemption from the requirements stated in 1 O CFR 70.24, "Criticality Accident Requirements" for criticality alarms to be located in the new Centrifuge Storage Building (CSB), currently being planned for construction. provides an affidavit whereby UUSA considers the information provided in Enclosure 2 as proprietary and/or commercial sensitive information that is privileged and confidential. provides the descriptions and supporting references of the proposed exemption. in the form of an ln'troduction, Proposed Changes, Technical Basis for the Proposed Changes, Safety Significance Determination and Environmental Considerations.
UUSA requests that Enclosure 2 be withheld from public disclosure as provided by 10 CFR 2.390(a)(4) and (d) because it contains proprietary and/or commercial sensitive information that is privileged and confidential. The enclosed Affidavit (Enclosure 1) supports this withholding request.
UUSA respectfully requests a prompt Acceptance Review of this LAR.

LES-25-075-NRC ENCLOSURE1 Affidavit USA The National Enrichment Facility I, Paul Lorskulsint, being duly sworn, state that I am the Chief Nuclear Officer for Louisiana Energy Services, LLC (LES) at the Urenco USA Facility; that I am authorized on the part of said company to sign and file with the Nuclear Regulatory Commission this document; and that all statements made and matters set forth herein are true and correct to the best of my knowledge, information, and belief:
LES wishes to have withheld from public disclosure the following document:

License Amendment Request (LAR-25-03), Centrifuge Storage Building - Criticality Accident Alarm System Exemption Request The information contained in the document cited above for which exemption from public disclosure is requested is owned by LES. The information contained in the documents cited above for which exemption from public disclosure is requested includes confidential business proprietary, trade secret, and/or commercially sensitive information related to commercial aspects of the Urenco USA Facility operated by LES, its operation and/or commercially sensitive LES business plans. LES is likely to suffer competitive disadvantages from disclosure of the referenced information. Accordingly, LES requests that the confidential, proprietary, and Sensitive Unclassified Non-Safeguards Information (SUNSI) be exempt from disclosure pursuant to the provisions in 10 CFR 2.390(a)(4) and 10 CFR 2.390(d).
Public disclosure of the information in the attached enclosure to this submittal has the potential to result in substantial harm to the competitive position of LES, unfairly provide valuable company proprietary business information to competitors of LES which the competitors could utilize to their benefit without having to expend their own resources to develop and to interfere with LES business strategies, and such disclosure could reduce or foreclose the availability of profit opportunities.
The information sought to be withheld is not available in public sources, to the best of LES' knowledge and belief.
The information stated in this affidavit has been submitted in accordance with the applicable parts of 10 CFR 2.390 and the guidance from NRC RIS-2004-11.
