CONCLUSION OF SECTION 106 CONSULTATION AND NOTICE OF AVAILABILITY OF THE FINAL GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS, SUPPLEMENT 10, SECOND RENEWAL, REGARDING SUBSEQUENT LICENSE RENEWAL FOR PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3, SUPPLEMENT 1, FINAL REPORT (DOCKET NUMBERS: 50-277 AND 50-278)

Dear President Deborah Dotson:

The U.S. Nuclear Regulatory Commission (NRC) staff is conducting a review of the environmental effects of the proposed renewal of the operating licenses for Peach Bottom Atomic Power Station Units 2 and 3 (Peach Bottom) for an additional 20 years. Peach Bottom is operated by Constellation Energy Generation, LLC, formerly Exelon Generating Company, LLC (Exelon), and is located in York County, Pennsylvania. Exelon submitted an application for Peach Bottom subsequent license renewal (SLR) by letter dated July 10, 2018, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html, under Package Accession No. ML18193A689.

The purpose of this letter is to inform you of the notice of the public availability of the final supplement for the Peach Bottom SLR application supplemental environmental impact statement (SEIS) (ML25191A237) and to document the NRCs conclusion of the National Historic Preservation Act of 1966, as amended (NHPA), Section 106 consultation consistent with Title 36 of the Code of Federal Regulations (CFR) Part 800.

On January 31, 2020, a notice was published in the Federal Register (FR) (85 FR 5725), stating that the NRC staff had issued its final SEIS documenting its analysis and conclusions. A notice of issuance of the subsequent renewed facility operating licenses was published in the FR on March 11, 2020 (85 FR 14247). Subsequently, the Commission directed the staff to modify the license expiration dates to reflect the end dates of the previous renewed facility operating licenses (i.e., August 8, 2033, for Peach Bottom, Unit 2 and July 2, 2034, for Peach Bottom, Unit 3), which the staff did on March 25, 2022 (ML22073A207). The Commission separately directed the NRC staff to conduct rulemaking and update Revision 1 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, to cover the August 26, 2025

environmental impacts of renewing the operating license of a nuclear power plant during the SLR term.

On August 6, 2024, the NRC published a final rule (89 FR 64166) revising its environmental protection regulations in 10 CFR 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The final rule updated the potential environmental impacts associated with the renewal of an operating license for a nuclear power plant for up to an additional 20 years, for either an initial license renewal or one SLR term. Revision 2 of NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (ML24087A133) provides the technical basis for the final rule. The final rule became effective on September 5, 2024. Accordingly, consistent with its regulations and Commission direction, the NRC prepared a supplement for the Peach Bottom SLR application to address new information obtained since the final SEIS was published.

On May 23, 2025, and May 28, 2025, the NRC notified the Advisory Council on Historic Preservation (ACHP) and Pennsylvania State Historic Preservation Officer (PA SHPO), and fifteen Tribes, respectively, that the draft supplement was published and available for public comment, which included the NRC staffs finding of no adverse effect to historic properties and that the NRC would be using 36 CFR 800.8(c) to comply with NHPA Section 106 through the National Environmental Policy Act of 1969, as amended, process. Responses were received from the ACHP (no comments), one Tribe (whose response indicated that the project is located outside their area of interest), and PA SHPO. The response from PA SHPO, dated June 18, 2025, concurred with the NRCs determination and indicated no effect to historic properties. All information on NHPA Section 106 consultation is detailed in the final supplement in Section 3.9 and Appendix C.
