I am following up on your question below regarding the LWA letter.
Following the receipt of the NRC staffs response to your September 6, 2024 letter, you asked about whether we could provide additional information or guidance about the underlying purpose of 10 CFR 50.10(d). Such guidance or explanation would be generically applicable and, as such, would need to be prepared under the NRCs processes for communicating generic information (for example, an Interim Staff Guidance document).
The timeline for preparing such a document may not meet the needs you have communicated to us for submitting your LWA application by January 2026, as such guidance has not been previously planned and would have to be ranked amongst other agency priorities.
However, if you have fact specific or case specific questions about planned exemptions for SMR-300, the NRC staff can support discussions on those specific questions and may be able to offer feedback or observations. In this case, SMR (Holtec) should identify the specific provisions of the LWA rule and the particular details of the SMR-300 design about which SMR (Holtec) would like to seek clarification regarding the applicability of the provisions of the rule.

Thank you again for the LWA letter. We are glad to have some feedback on our approach, and we have been spending a lot of time thinking it over this week. As I mentioned when we spoke earlier this week, we still have some questions. The most significant of these is on the underlying purpose of 10CFR50.10(d).
In our letter (paragraph 1.2.1), we stated our understanding of the underlying purpose of 50.10(d) and requested either NRC agreement or clarification of the underlying purpose. Page 4 of the response (first paragraph) acknowledges SMRs view but neither states agreement nor provides clarification.
Should we understand this to mean that the NRC agrees with SMRs view?
Please let me know if youd like to have a phone call or an in-person meeting to discuss.
Also, please let me know how things are progressing for feedback on the LWA PSAR content.
