CONCLUSION OF SECTION 106 CONSULTATION AND NOTICE OF AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR THE CLINTON POWER STATION, UNIT 1 LICENSE RENEWAL APPLICATION (DOCKET NUMBER: 50-461)

Dear Chairperson Gena Kakkak:

The U.S. Nuclear Regulatory Commission (NRC) is conducting a review of the environmental effects of the proposed renewal of the operating license for Clinton Power Station, Unit 1 (CPS) for an additional 20 years. CPS is operated by Constellation Energy Generation, LLC (CEG) and is located in Clinton, Illinois. CEG submitted an application for the license renewal in a letter dated February 14, 2024, pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html under Package Accession No. ML24045A023. The current CPS operating license will expire in 2027; the NRCs Federal action is to decide whether to renew the license, authorizing an additional 20 years of operation. The purpose of this letter is to inform you of the notice of the public availability of the final supplemental environmental impact statement (SEIS)

(ML25212A224) and to document the NRCs conclusion of the National Historic Preservation Act of 1966, as amended (NHPA), Section 106 consultation consistent with Title 36 of the Code of Federal Regulations (36 CFR) Part 800.

On April 30, 2024, the NRC initiated Section 106 consultation and notified by letters the Advisory Council on Historic Preservation (ACHP), Illinois State Historic Preservation Officer (IL SHPO), and Tribes of its decision to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under NHPA Section 106, in accordance with 36 CFR 800.8(c). The letters also provided information about the proposed action, defined the area of potential effects (APE), and invited Tribes who might attach religious and cultural significance to historic properties in the APE an opportunity to identify their concerns, provide advice on the identification and evaluation of historic properties, including those of traditional religious and cultural importance, and, if necessary, participate in the resolution of any adverse effects to such properties. Additional letters were sent on October 21, 2024, which also included several other Tribes. A response was received from the Kickapoo Traditional Tribe of Texas indicating that none of the Tribes known cultural, historical, or sacred sites would be affected.

On September 25, 2024, the NRC staff met with the IL SHPO in person to discuss the undertaking.

On April 11, 2025, the NRC notified the ACHP, IL SHPO, and Tribes that the draft SEIS was published and available for public comment, which included the NRC staffs finding of no adverse effect to historic properties. Responses were received from the ACHP and the IL SHPO. No comments were received from Tribes. The NRC provided a response to the IL SHPOs written request for additional information, and subsequently on July 7, 2025, the IL SHPO sent correspondence to the NRC indicating that it concurred with the NRC staffs findings and thus no historic properties are affected. All information on NHPA Section 106 consultation is detailed in the final SEIS in Section 3.9 and Appendix C.
