KANSASS NON-STANDARD LICENSE CONDITION REQUEST
Dear David Lawrenz:
We have completed our review of Kansass non-standard license condition request which was received by our office on March 14, 2025. The intent of this condition is to place a license condition for the proper disposal or transfer of older sources. This requirement was evaluated against the corresponding U.S. Nuclear Regulatory Commission (NRC) regulations and applicable guidance documents, as reflected in the enclosed State Regulation Status (SRS)
Data Sheet. We discussed the content and applicability of this non-standard license condition requirement with you on June 2, 2025.
Following our discussion, Kansas intends to add this non-standard license condition to applicable active licenses. This approach is intended to strengthen enforceability and ensure the condition is legally binding, where appropriate and it does not appear to present any conflict, duplication, or regulatory gaps under the Atomic Energy Act of 1954, as amended.
Based on our review, we have no comments. We have determined that the non-standard license condition meets the compatibility and health, and safety categories defined in NMSS Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that you notify us when the proposed licensed condition is finally implemented. As requested in NMSS Procedure SA-201, "Review of State Regulatory Requirements," please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State and Tribal Programs, NMSS.
The SRS Data Sheet summarizes our knowledge of the status of other Kansas regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet.
