REQUEST FOR RELIEF/EXTENSION FOR TITLE 10 OF THE CODE OF FEDERAL REGULATIONS 74.13(a)

Dear Mr. Huth:

This letter provides the U.S. Nuclear Regulatory Commission (NRC) response to your request for relief from requirements in Title 10 of the Code of Federal Regulations (10 CFR) Part 74, for the filing of certain reports to the NRC.

BACKGROUND By email dated May 27, 2025 (Agencywide Documents Access and Management Systems (ADAMS) Accession Number ML25153A499), the licensee, Sequoyah Nuclear Power Plant, Units 1 & 2, requested an extension for the filing of the Material Status Report for the facility, reporting as identification symbol (RIS code) XLB. As required by 10 CFR 74.13(a), Material status reports, these reports are to be submitted within 60 calendar days of the beginning of the physical inventory. Your email cites an observed erroneous calculation following inventory taking for material type 50, for which you are actively seeking resolution with your software vendor. You have also confirmed that the calculation is not the result of loss, theft, or diversion of material and that there is no apparent safety or security concern. At this time, you are uncertain whether the software error will be resolved by the time your inventory is due for submission on May 30, 2025, and you have requested temporary relief for reporting your material status report to the Nuclear Materials Management and Safeguards System (NMMSS).

DISCUSSION The regulations in 10 CFR 74.13(a) state that The Commission may permit a licensee to submit the reports at other times for good cause. The Commission may grant exemptions to the requirements of regulations upon determining that the exemption is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest.

The NRC staff has reviewed this request and finds that granting a specific exemption for this year from the date of May 30, 2025 for filing the Material Status Report, as required under 74.13(a), is: authorized by law as part of the Commissions statutory authority to collect such information; will not endanger life or property or the common defense and security, as the licensee continues to maintain control and accounting of its material; and is otherwise in the public interest in that the licensee commits to submitting the reports within a reasonable June 5, 2025

extension period. The NRC staff finds that the licensee has completed physical inventory and is engaged in active resolution of the reporting issue and intends to submit the reports to NMMSS as soon as possible. The NRC therefore grants XLB an exemption from the required filing date of March 30, 2025, and sets a new date for submittal of June 30, 2025.

If XLB does not believe it can meet the new date, XLB shall contact the NRC as soon as possible. Failure to receive an exemption prior to the due date, may result in noncompliance with 10 CFR 74.13(a). The NRC Enforcement Policy (ML19352E921) allows for the exercise of enforcement discretion under certain circumstances.
