Dear Christy Johnson-Hughes:

With this letter, the U.S. Nuclear Regulatory Commission (NRC) gives written notice to the U.S. Fish and Wildlife Service (FWS) of the designation of Duke Energy Progress, LLC (Duke) as its non-Federal representative to conduct informal consultation under Section 7 of the Endangered Species Act of 1973, as amended (ESA), for the H.B. Robinson Steam Electric Plant, Unit No. 2 (Robinson) subsequent license renewal application pursuant to Title 50 of the Code of Federal Regulations (50 CFR) Section 402.08, Designation of non-Federal representative.

By letter dated April 1, 2025, Duke, the licensee for Robinson, submitted an application to subsequently renew the Robinson Renewed Facility Operating License No. DPR-23, which expires July 31, 2030 (Agencywide Documents Access and Management System Accession No. ML25091A290). If granted, the subsequent renewed license would allow Duke to operate Robinson for an additional 20 years beyond its current licensed operating period (i.e., through July 31, 2050). As part of its review of this application, the NRC staff must consult with the FWS if the proposed action may affect federally listed species or critical habitat in accordance with ESA Section 7(a)(2). With its designation as the NRCs non-Federal representative, Duke will conduct informal consultation with your office in accordance with 50 CFR 402.13, Informal consultation. The NRC understands that the ultimate responsibility for compliance with ESA Section 7 remains with the NRC, as the Federal action agency.
