NOTICE OF AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT AND FINDING OF NO HISTORIC PROPERTIES AFFECTED FOR PERRY NUCLEAR POWER PLANT, UNIT 1 LICENSE RENEWAL, LAKE COUNTY, OHIO (DOCKET NUMBER: 50-440)
Dear Chief Douglas Lankford:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed the environmental impact statement NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 61, Regarding License Renewal for Perry Nuclear Power Plant Unit 1, Final Report (FEIS). Perry Nuclear Power Plant Unit 1, (Perry Plant), is operated by Vistra Operations Company LLC, and is located in Lake County, Ohio. The NRC staff-initiated consultation with you regarding this project in October 2023. In accordance with Title 36 of the Code of Federal Regulations Section 800.8(c), the NRC staff elected to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under Section 106 of the National Historic Preservation Act of 1966, as amended. As such, Section 3.9 of the FEIS documents the staffs findings with regard to historic and cultural resources at the Perry site.
In a letter dated September 6, 2024, the NRC provided the NRCs Agencywide Documents Access and Management System (ADAMS) web address and accession number for the draft supplemental environmental impact statement to your office. The FEIS includes the NRC staffs evaluation of the environmental impacts of the license renewal (LR) for the Perry Plant and alternatives to the LR. As documented therein, the NRC staffs recommendation is that the adverse environmental impacts of the LR for the Perry Plant (i.e., the continued operation of the Perry Plant for a period of 20 years beyond current expiration dates) are not so great that preserving the option for energy-planning decision-makers would be unreasonable. Further, the NRC staff concludes that no historic properties would be affected.
