OF APRIL 22, 2025, PARTIALLY CLOSED PRE-SUBMITTAL MEETING HELD WITH SOUTHERN NUCLEAR OPERATING COMPANY, INC.,
REGARDING A PROPOSED LICENSE AMENDMENT REQUEST TO CHANGE TECHNICAL SPECIFICATION 4.3.1, CRITICALITY, FOR VOGTLE ELECTRIC GENERATING PLANT, UNITS 3 AND 4 (EPID L-2025-LRM-0040)
On April 22, 2024, a Partially Closed meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Southern Nuclear Operating Company, Inc.
(SNC, the licensee). The purpose of the meeting was for SNC to describe its plan to submit a license amendment request (LAR) for Vogtle Electric Generating Plant (Vogtle), Units 3 and 4.
SNC is proposing to change Technical Specification (TS) 4.3.1, Criticality, related to fuel storage. In addition, SNC is proposing to change TS Figure 3.7.12-1, Minimum Fuel Assembly Burnup Versus Initial Enrichment for Region 2 Spent Fuel Cells, of TS 3.7.12, Spent Fuel Pool Storage.

On April 9, 2025 (Agencywide Documents and Access Management System (ADAMS)
Accession No. ML25099A138), the meeting was noticed on the NRC public webpage.
The NRC staff opened the meeting with introductory remarks and a roll call of the attendees.
The SNC representative submitted original slides contained in ML25105A210 and presented revised slides contained in ML25115A040.
SNC representatives discussed the following topics: (1) background, (2) change, (3) justification, and (4) schedule.

Background===
SNC stated that current TS 4.3.1.1.a states:
Fuel assemblies having a maximum U-235 enrichment of 4.95 weight percent; SNC said that methodology used in the spent fuel pool criticality analysis is provided in APP-GW-GLR-029 (ML110670298).
SNC stated that current TS 4.3.1.2.a states:
Fuel assemblies having a maximum U-235 enrichment of 5.0 weight percent; SNC said that the methodology used in the new fuel pool criticality analysis is provided in APP-GW-GLR-030 (ML061520157).
Change SNC stated that proposed TS 4.3.1.1.a would state:
Fuel assemblies having a maximum nominal U-235 enrichment of 4.95 weight percent; SNC stated that proposed TS Figure 3.7.12-1 would state:
Figure 3.7.12-1, Minimum Fuel Assembly Burnup Versus Initial Nominal Enrichment for Region 2 Spent Fuel Cells Justification SNC said that the proposed changes to TS 4.3.1.1.a and Figure 3.7.12-1 are consistent with the safety analysis, and meet the requirements of 10 CFR 50.68, Criticality accident requirements.
Schedule SNC stated that it planned to submit the proposed LAR by May 1, 2025. SNC said that it needs the LAR by September 19, 2025, to order fuel for Vogtle, Unit 3, Cycle 3. SNC requested the NRC complete its LAR review by September 18, 2025.
Discussion The NRC staff asked the following questions:
What is the difference between maximum nominal enrichment terminology and maximum enrichment terminology of spent fuel pool criticality analysis provided in APP-GW-GLR-029 (ML110670298)?
Please clarify the rationale for the proposed TS Bases change for TS 3.7.12?
Closing Remarks There was one member of the public in attendance. The member of the public asked about Figure 3.7.12-1.
The NRC staff did not make any regulatory decisions during the meeting. Once received, the NRC staff will perform a thorough review of the proposed LAR. The NRC staff will make any regulatory decisions in writing in a timely manner. Public Meeting Feedback forms were available, but no comments were received.
