Dear Mr. Blind:
Your email titled "Supplemental Paper for PRM-50-125 - Request for Docket Inclusion" with attached new paper titled, "Update to July 1, 2024 Petition for Rulemaking," will be included in the public rulemaking docket as a comment after the deadline. Additionally, public comments will be discussed in the NRC's disposition of your petition for rulemaking. The NRC's regulations at 10 CFR 2.803 explain how the NRC acts on a petition for rulemaking. Following the publication of the notice of docketing in the Federal Register, the NRC determines the appropriate regulatory action to take in response to the petition for rulemaking. The Commission reviews and determines how to disposition the petition issue(s), and the NRC will inform you (the petitioner) in writing of its decision.

Dear Ms. Lugo,
Thank you for your January 13, 2025 email providing the status update on Petition for Rulemaking PRM-50-125.
I am writing to submit a new paper titled "Update to July 1, 2024 Petition for Rulemaking" This paper reflects significant new legal and regulatory developments that have occurred since the close of the public comment period and are directly relevant to the petition.
Most notably, it incorporates:
The NRC Staff's formal response to our hearing request (ML24309A276),
The ASLBs March 31, 2025 decision (LBP-25-04, ML25090A164),
The NRCs April 7, 2025 2.206 screening determination letter, and The U.S. Supreme Courts ruling in Loper Bright Enterprises v. Raimondo, which overruled the longstanding Chevron doctrine.
Taken together, these developments further underscore the need for a clear, Commission-approved process for returning decommissioned reactors to operation, and they support the original basis of the petition.
Given the timeliness and relevance of this material, I respectfully request that the attached paper be added to the PRM-50-125 docket as a supplemental filing for consideration during the Commissions final determination.
