APPROVAL OF THE ORANO ENRICHMENT USA, LLC, ENVIRONMENTAL REPORT EXEMPTION REQUEST - ENTERPRISE PROJECT IDENTIFIER L-2025-LLE-0010
Dear Peter Vescovi:
Orano Enrichment USA, LLC (Orano) submitted a letter dated February 5, 2025 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML25036A341),
requesting an exemption from the requirements in Title 10 of the Code of Federal Regulations (10 CFR) 51.60(a), "Environmental reportmaterials licenses," and 70.21(h), "Filing." The exemption is requested for the purpose of permitting Orano to submit environmental report (ER) information required by 10 CFR Part 51 separately from and before, but within 6 months of, the remainder of its license application for Project IKE, a proposed uranium enrichment facility to be located in Oak Ridge, Tennessee. Under current regulations, an applicant must submit the ER concurrently with the remainder of the license application package.
A safety evaluation report of the U.S. Nuclear Regulatory Commission (NRC) staffs review of Orano's request is provided in the enclosure to this communication. The NRC staff finds that granting the exemption is authorized by law, will not endanger life or property or common defense and security, and is otherwise in the public interest. Therefore, the NRC staff grants Orano a temporary exemption from the requirement in 10 CFR 51.60(a) and 10 CFR 70.21(h) that an ER be submitted with its application. This exemption will expire 6 months after official receipt of the ER in the Agencywide Documents Access and Management System (ADAMS).
The exemption expires if the remainder (i.e., safety and safeguards discussion portion) of the application is not submitted by that date. Neither granting the exemption request nor beginning a review of the ER prior to receipt of the safety and safeguards portion indicates a commitment by the NRC to accept the license application for docketing.
This letter closes all efforts under Enterprise Project Identifier L-2025-LLE-0010.
