NOTICE OF A PROPOSED AGREEMENT WITH THE STATE OF CONNECTICUT
Dear President Holsey:
By letter dated October 31, 2024, the Governor Ned Lamont, on behalf of the State of Connecticut, requested that the U.S. Nuclear Regulatory Commission (NRC or Commission) enter into an Agreement with the State of Connecticut, as authorized by Section 274b. of the Atomic Energy Act of 1954, as amended (AEA). Under the proposed Agreement, the Commission would discontinue, and the State of Connecticut would assume regulatory authority over certain types of byproduct materials as defined in Sections 11e.(1), 11e.(3), and 11e.(4) of the AEA, source material, special nuclear material in quantities not sufficient to form a critical mass, and 104 related licenses (Agencywide Documents Access and Management System Accession No. ML24306A079). Additionally, the NRC would conduct periodic performance reviews of the State to assure compliance with the provisions of Section 274 of the AEA.
In compliance with the Commissions policy6, the NRC staff prepared a draft assessment (ML25070A186) of the States regulatory program. The draft assessment was submitted for Commission review, and updated based on direction from SRM-SECY-25-0010, Proposed Agreement Between the State of Connecticut and the Commission Pursuant to Section 274 of the Atomic Energy Act of 1954, as Amended (ML25069A705).
Section 274e. of the AEA requires that the terms of the proposed Agreement be published in the Federal Register for comment. In accordance with the NRCs Tribal Policy Statement, the NRC is informing your Tribe that the Connecticut proposed Agreement and the summary of the NRCs staff draft assessment was been published in the Federal Register (90 FR 12795) on March 18, 2025 and can be found at Federal Register: State of Connecticut: NRC Staff Assessment of a Proposed Agreement Between the Nuclear Regulatory Commission and the State of Connecticut. The comment period ends on April 18, 2025. The NRC encourages electronic comment submission through the Federal rulemaking website at https://www.regulations.gov/ under Docket ID NRC-2025-0010.
