TEXAS ENGINEERING EXPERIMENT STATION/TEXAS A&M UNIVERSITY SYSTEM - NONACCEPTANCE OF THE APPLICATION FOR A LICENSE AMENDMENT RE: TRANSFER OF BYPRODUCT MATERIAL FROM STATE LICENSE (EPID: L-2024-NFA-0004)
Dear Mr. Jenkins:
By letter dated December 5, 2024 (Agencywide Documents Access and Management System Accession No. ML24340A112), as supplemented on January 8, 2025 (ML25008A256), Texas Engineering Experiment Station/Texas A&M University System applied for an amendment to Facility Operating License No. R-83 for the Texas A&M University System TRIGA nuclear research reactor. The license amendment request (LAR) proposes a revision of the license conditions for transfer of byproduct material used in association with facility operations to the R-83 license from the State of Texas Broadscope License. Consistent with Title 10 of the Code of Federal Regulations (10 CFR) Section 50.90, Application for amendment of license, construction permit, or early site permit, an application to amend the license (including the technical specifications) must fully describe the changes desired and follow, as far as applicable, the form prescribed for original applications. The requirements in 10 CFR 50.34, Contents of applications; technical information, cover the technical information to be included in the application and stipulate that it address design and operating characteristics, unusual or novel design features, and principal safety considerations.
The U.S. Nuclear Regulatory Commission (NRC) staff performed an acceptance review of the LAR and concluded that it did not provide sufficient information for the NRC staff to begin its detailed technical review. By email dated January 10, 2025 (ML25013A119), the NRC staff notified you of this conclusion and provided you with an opportunity to submit supplemental information by February 7, 2025. As of the date of this letter, the NRC staff has not received the needed supplemental information. Therefore, the NRC staff finds the LAR to be unacceptable for NRC review pursuant to 10 CFR 2.101, Filing of application, and has ceased its review.
