DESIGNATION OF ORANO ENRICHMENT USA, LLC (ORANO), AS THE NON-FEDERAL REPRESENTATIVE FOR THE PROPOSED ORANO URANIUM ENRICHMENT FACILITY IN OAK RIDGE TENNESSEE (DOCKET NUMBER: 70-7038)
Dear Daniel Elbert:
With this letter, the U.S. Nuclear Regulatory Commission (NRC) gives written notice to the U.S. Fish and Wildlife Service (FWS) of the designation of Orano Enrichment USA, LLC (Orano) as its non-Federal representative to conduct informal consultation under Section 7 of the Endangered Species Act of 1973, as amended (ESA) for Oranos proposed uranium enrichment facility (also known as Project IKE) to be located in Oak Ridge, Tennessee, pursuant to Title 50 of the Code of Federal Regulations (50 CFR) 402.08, Designation of non-Federal representative.
Orano expects to submit an application to the NRC for a special nuclear material license to construct and operate a uranium enrichment facility under Title 10 of the Code Federal Regulations (10 CFR) Part 70, Domestic Licensing of Special Nuclear Material, by September 2025. This application will include an environmental report, which will provide the information specified in 10 CFR 51.45 to support the NRCs evaluation of the environmental impacts of licensing the proposed facility to meet requirements of the National Environmental Policy Act of 1969. As part of its review, the NRC staff must consult with the FWS if the proposed action may affect federally listed species or critical habitats in accordance with ESA Section 7(a)(2). By designating Orano as the non-Federal representative, Orano will conduct consultation with your office in accordance with the regulations that guide informal consultation at 50 CFR 402.13. We understand that the ultimate responsibility for compliance with ESA Section 7 remains with the NRC, as the Federal action agency.
