ACCEPTANCE FOR REVIEW OF PENNSYLVANIA STATE UNIVERSITYS SELF GUARANTEE - ENTERPRISE PROJECT IDENTIFIER NUMBER L-2025-NFO-0002

Dear Virginia Teachey:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your submittal dated December 13, 2024 (Agencywide Documents Access and Management System (ADAMS)

Number ML24362A094), transmitting the instrument for financial assurance in a Self-Guarantee.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed review. Your submittal has been assigned Enterprise Project Identification Number (EPID) L-2025-NFO-0002. Please reference this EPID number and Docket Number 70-0113 in any future correspondence associated with this request.

The Financial Assessment Branch (FAB) staff Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.75(e)(1)(iii)(C), Reporting and Recordkeeping for Decommissioning Planning, and Appendix E to 10 CFR Part 30, Criteria Relating to Use of Financial Tests and Self-Guarantee for Providing Reasonable Assurance of Funds for Decommissioning by Nonprofit Colleges, Universities, and Hospitals, Pennsylvania State University (Penn State) submitted a self-guarantee letter to the NRC demonstrating financial assurance for decommissioning (possession and use of radioactive materials), dated December 13, 2024 (ML24362A094).

Based on its review, the NRC staff finds that the Penn State self-guarantee agreement meets the financial test criteria for a nonprofit college that issues bonds. Penn States submittal conforms to the guidance in NUREG-1757, Volume 3, Revision 1 Consolidated Decommissioning Guidance; Financial Assurance, Recordkeeping, and Timeliness. The application contains sufficient information, as required by 10 CFR Part 30 and 10 CFR 50.75., to allow the staff to initiate, follow through and complete its detailed technical analysis, and make an independent assessment regarding the annual update, in terms of regulatory requirements that protects public health and safety and advancement of nations common defense and security by enabling the safe and secure use and deployment of civilian nuclear energy technologies and radioactive materials.

If additional information is needed during the detailed technical review, you will be advised by correspondence. The NRC staff has estimated that this licensing request will take approximately 104 staff hours to complete (annual assurance review only). The NRC staff expects to complete this review by July 31, 2025. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions.

These estimates are based on the staffs initial review of the application, and they could change, due to several factors including, among other things, requests for additional information, and unanticipated addition of scope to the review. We will promptly communicate significant schedule or cost changes, if any.

In accordance with 10 CFR Part 2 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
