SUMMARY
OF MARCH 4, 2025, PUBLIC MEETING WITH RENSSELAER POLYTECH INSTITUE TO DISCUSS POTENTIAL LICENSING ACTION On January 15, 2024, (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML25052A067), the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with Rensselaer Polytechnic Institute (RPI) staff to discuss a potential licensing action to address facility staffing.
During the meeting, RPI presented slides (ML25072A256) and a draft proposed license amendment (ML25072A257) which would, among other minor changes, create a new section in its Technical Specifications (TS). The proposed new section, Special Administrative Controls for Extended Shutdowns, would modify administrative controls to accommodate limited staffing.
RPI explained that it was unable to meet its current TS as in October 2024 the Critical Experiments Facility was defueled and the reactor operators sought other employment. RPI was unable to comment on the future of the facility as long-term plans were being developed by university administration.
RPI requested feedback on the proposed license amendment. The NRC staff stated that some licensees create limited scope alternatives within existing sections of the TS, instead of creating new sections to address nonstandard conditions.
The NRC staff answered questions regarding licensing and regulatory processes. The NRC staff provided a high-level overview of License Amendment Review Procedures (ML19248C539). Additionally, the NRC staff explained that Title 10 of the Code of Federal Regulations (10 CFR) permits licensees and other parties to request, and the Commission to grant, exemptions from the requires of NRC regulations. Some of the NRC regulations may not be addressed by a license amendment. The NRC staff emphasized that requirements for exemptions may differ between parts of 10 CFR. H. Cruz exemption requests could be found in ADAMS. NRC staff discussed that documents generated in response to a request will generally cite the request, and any supplements. With some exceptions, the request, supplements, and NRC response can be viewed in ADAMS on the NRCs website. RPI staff stated it would review other examples.
