ARIZONA LEGALLY BINDING REQUIREMENT
Dear Brian D. Goretzki:
We have reviewed Arizonas legally binding standard license condition requirement, received by our office on February 24, 2025. This requirement was reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and requirements in Title 10 of the Code of Federal Regulations (10 CFR) 35.41. We discussed our review of the legally binding requirement with you on March 28, 2025.
As a result of our review, we have one health and safety comment and one editorial comment, that have been identified in the Enclosure 1. We have determined that if this requirement is revised, incorporating our comment and recommendations and without other significant change, it would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that when you revise your legally binding requirement to address our comment, a copy of the license condition be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes and provide a copy to the NRCs Division of Materials Safety, Security, State, and Tribal Programs, NMSS.
The State Regulation Status (SRS) Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Arizona regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. Paragraph B At a minimum, the procedures required by Part A of this section must address the following items that are applicable to the licensee's use of byproduct material-(1) Verifying the identity of the patient or human research subject; (2) Verifying that the administration is in accordance with the treatment plan, if applicable, and the written directive; (3) Checking both manual and computer-generated dose calculations; (4) Verifying that any computer-generated dose calculations are correctly transferred into the consoles of therapeutic medical units authorized by §§ 35.600 or 35.1000; (5) Determining if a medical event, as defined in R9-7-745, has occurred; and (6) Determining, for permanent implant brachytherapy, within 60 calendar days from the date the implant was performed, the total source strength administered outside of the treatment site compared to the total source strength documented in the post-implantation portion of the written directive, unless a written justification of patient unavailability is documented.

In paragraph B(4) of the license condition, Arizona states...therapeutic medical units authorized by §§ 35.600 or 35.1000; which is a reference to NRC requirements
§35.600 and §35.1000. The Arizona equivalent to §35.600 and §35.1000 is R9-7-Exhibit A Group 600 and 1000.
Arizona needs to replace §§ 35.600 or 35.1000 with R9-7-Exhibit A Group 600 or 1000 in paragraph B(4) of the proposed standard license condition.
Arizona needs to make this change to meet the H&S designation assigned to
§35.41(b).

Paragraph C A licensee shall retain a copy of the procedures required under Part A in accordance with §35.2041.
§35.41(c)
D Procedures for administrations requiring a written directive.
In paragraph C of the license condition, Arizona states A licensee shall retain a copy of the procedures required under Part A in accordance with §35.2041 which is a reference to NRCs requirement
§35.2041. However, Arizona should provide a reference to their own equivalent rule.
Arizona should either delete paragraph C of the license condition or revise the paragraph to reference the Arizona rule equivalent to NRCs §35.2041.
Please note that both §35.41(c) and
§35.2041 are compatibility D and therefore do not need to be adopted by Arizona.
