OVERVIEW:
As part of an application for an NRC license submitted by a commercial entity an applicant or preapplicant may, in certain circumstances, require access to safeguards information (SGI) information to prepare its application. The purpose of this document is to provide U.S.
Nuclear Regulatory Commission (NRC) applicants or preapplicants with preliminary information and resources to help navigate the communication process for requesting access to NRC SGI information.1 Section 147 of the Atomic Energy Act of 1954, as amended (AEA),
provides the NRC with the authority to issue regulations or orders for the protection of certain information, designated as SGI, from unauthorized disclosure. Consistent with section 147(a)(1)(3) of the AEA, SGI is information that specifically identifies a licensees or applicants detailed security measures or control and accounting procedures for the physical protection of special nuclear material; security measures for the physical protection of source material or byproduct material; or security measures for the physical protection of and the location of vital plant equipment.
Consistent with the authority granted by section 147 of the AEA, the NRC has promulgated regulations for the protection of SGI in Title 10 of the Code of Federal Regulations (10 CFR) 73.21, 73.22, and 73.23:
10 CFR 73.21 sets forth performance requirements for the possession and use of SGI.
10 CFR 73.22 addresses activities related to power reactors; a formula quantity of strategic special nuclear material; transportation of or delivery to a carrier for transportation of a formula quantity of strategic special nuclear material or more than 100 grams of irradiated reactor fuel; uranium hexafluoride production or conversion facilities; fuel fabrication facilities; uranium enrichment facilities; independent spent fuel storage installations; and geologic repository operations areas.
10 CFR 73.23 addresses activities related to research and test reactors that possess special nuclear material of low or moderate strategic significance.

These instances will be treated on a case-by-case basis and require the entity or person to contact the NRCs Office of Nuclear Security and Incident Response (NSIR), Information Security Branch (ISB).

SGI REQUEST PROCESS:
Step 1: Preparation Applicants and preapplicants should review section 147 of the AEA, and the regulatory requirements in 10 CFR 73.21, 73.22, and 73.23. This review will help applicants and preapplicants to understand the statutory and regulatory requirements governing the use and possession of SGI.
Step 2: Initial Inquiry After completing this review, applicants and preapplicants should contact their NRC licensing project manager and indicate that they are seeking access to NRC SGI information. Applicants and preapplicants should be prepared to explain why they need access to SGI. The NRC project manager will arrange for a meeting with the appropriate NSIR/ISB staff member. The NSIR/ISB staff member will provide the applicant or preapplicant with a verbal presentation of how an SGI program should operate, consistent with the guidance in NRC Regulatory Guide 5.79, Protection of Safeguards Information. The staff member will also confirm that the information that the preapplicant or applicant is seeking access to is actually SGI. Following this overview, the applicant or preapplicant can decide if they would like to submit a request for NRC SGI information.
Step 3: SGI Access Request Formal requests to access NRC SGI information must be submitted in writing to the applicants or preapplicants project manager. If the NRC determines that the applicant is likely to need access to NRC SGI, the applicant will receive a letter suggesting that it submit to the NRC a formal access request. The purpose of this letter is to approve the need for the use and possession of NRC SGI at the applicants or preapplicants facility. The letter does not mean the applicant or preapplicant is approved to use NRC SGI information.
Step 4: NRC Review of the SGI Request The NRCs licensing project manager will contact the appropriate NSIR/
ISB staff member and begin an initial review of the SGI access request.
The NRC will conduct a review to determine that the preapplicant or applicant has or will establish, implement, and maintain an information protection system consistent with the requirements found in 10 CFR 73.21, 10 CFR 73.22, and 10 CFR 73.23. The NRC may have additional questions for the facilitys SGI designation manager, addressing for example the 2
overall security posture of the facility and implementing procedures for the protection of SGI. The goal is to give the NSIR/ISB staff member a sufficient understanding of the proposed protection measures to ensure compliance with the NRCs regulations. The NRC must have assurance that the applicant or preapplicant will prevent the unauthorized disclosure of SGI. The NRC has created Regulatory Guide 5.79 to Protection of Safeguard Information help guide the applicant or preapplicant through establishment of SGI protection measures.
After the onsite assessment is completed and the applicants or preapplicants compliance with 10 CFR 73.21, 10 CFR 73.22 has been verified, the NRC will notify the applicant or preapplicant in writing of its final determination to grant or deny the request for access to NRC SGI information.
