PRM-50-120: February 2025 Status Update Stephanie Terwilliger, I am contacting you to provide a status update on a petition for rulemaking (PRM) that was submitted to the U.S.
Nuclear Regulatory Commission (NRC) by Mr. Thomas A. Bergman on behalf of NuScale Power, LLC, dated August 19, 2019.
The petition requested that the NRC amend Title 10 of the Code of Federal Regulations (10 CFR), Section 50.61, Fracture Toughness Requirements for Protection against Pressurized Thermal Shock Events, to alleviate a requirement for calculating the embrittlement for advanced reactor designs and add the formula for calculating the mean value of the transition temperature shift for the embrittlement trend curve as described in American Society for Testing and Materials (ASTM) E900-15, Standard Guide for Predicting Radiation-Induced Transition Temperature Shift in Reactor Vessel Materials. Also included in the petition was a request that the NRC make corresponding changes to Regulatory Guide 1.99, Radiation Embrittlement of Reactor Vessel Materials.
The NRC continues to evaluate and address the resolution of the issues raised by PRM-50-120. Once the petition has been resolved, the NRC will publish a notice in the Federal Register explaining the NRCs "nding. You will also receive a letter at that time notifying you of the action the NRC has taken. In the interim, the status of PRM-50-120 can be found at the NRC Rules and Petitions page at https://www.nrc.gov/about-nrc/regulatory/rulemaking/rules-petitions.html. This web site includes a link to a listing of all active NRC PRMs. You can monitor this site for status updates as they become available.
