Dear Mr. Williams:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated January 22, 2025 (Agencywide Documents Access and Management System Accession Number No. ML25022A240) and supplemented on February 4, 2025 (ML25036A335). The proposed action would allow Constellation to use the HI-STORM FW MPC Storage System, including the use of the HI-TRAC VW transfer cask, at the Nine Mile Point Nuclear Power Station ISFSI during loading and transport operations for MPC-89 where the terms, conditions, and specifications in Certificate of Compliance No.

1032, Amendment No. 3, Revision 0, are not met, and solely applies to the six planned loadings of MPC-89 beginning in May 2025. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations Part 72, sections 72.212(a)(2);

72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
