Review of the Draft Environmental Assessment for Maine Yankee ISFSI exemptions

Dear Mr. Hyland,

The purpose of this email is to notify you of the planned issuance of an exemption for the Maine Yankee Independent Spent Fuel Storage Installation, and to request your review of the draft environmental assessment (EA) for this action.

Background:

Maine Yankee is requesting the continuation of three exemptions from the terms and conditions of Amendment No. 9 to CoC No. 1015 (NAC-UMS spent fuel storage system) that were previously approved for Amendment No. 6 to CoC No. 1015.

Maine Yankee plans to adopt Amendment No. 9 to CoC No. 1015 as part of its work to adopt the Renewed CoC No. 1015. Maine Yankee submitted its exemption request by \

letter dated March 28, 2024 (ML24094A060), as supplemented by email dated October 30, 2024 (ML24304B052).

The requested exemptions are the same exemptions as have been previously reviewed and approved by the NRC on multiple prior occasions as the licensee has sought, over time, to use new amendments to CoC No. 1015.

The most recent NRC approval of the exemptions was in 2019 (https://www.govinfo.gov/content/pkg/FR-2019-07-10/pdf/2019-14711.pdf). The \

January 29, 2019, letter from the Maine Department of Health and Human Services noted the State had no objections to that prior exemption request (ML19038A057).

The NRC issued Amendment No. 9 to CoC No. 1015, effective August29,2022 (https://www.govinfo.gov/content/pkg/FR-2022-06-14/pdf/2022-12746.pdf).

The NRC staff verified that there is no change in the conditions under which the exemptions were previously approved. The NRC staff has prepared documentation of the exemption, which includes an EA for compliance with the National Environmental Policy Act.

Request:

For your review, the Federal Register notice (FRN) contains a draft EA for this proposed exemption (section III B. of the notice, Environmental Consideration).

Additional background about the exemption is provided in the FRN.
