Dear Steve Osting:

By letter L-24-233 dated December 18, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24353A315), Vistra Operations Company LLC (Vistra OpCo, the licensee) submitted an alternative request (RR-A1) to defer ASME Code,Section XI Inservice Inspection (ISI) examinations for Pressurizer and Steam Generator welds and full penetration welded nozzles from the current Davis-Besse Nuclear Power Station, Unit No. 1 (Davis-Besse) ASME Code,Section XI, 10-year requirement. The licensee requested to defer examinations for two 10-year ISI intervals from the last examination preformed for each item and the subject welds would be re-examined prior to the end of the current 60-year operating license for Davis-Besse (expiring April 22, 2037).

Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(z)(1), the licensee requested to use the proposed alternative on the basis that the alternative provides an acceptable level of quality and safety.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC, or the Commission) staffs acceptance review of the proposed request. The acceptance review was performed to determine whether the scope and depth of the technical information was sufficient to allow the NRC staff to complete its detailed technical review. The acceptance review also intended to identify within the request any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing bases of the plant.

The NRC staff has reviewed Vistras request and concluded that it provided technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the request in terms of regulatory requirements.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in Vistras request, the NRC staff has estimated that this request will take approximately 160 hours0.00185 days <br />0.0444 hours <br />2.645503e-4 weeks <br />6.088e-5 months <br /> to complete and that the review can be completed within 12 months (i.e.,

by January 7, 2026). If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during routine interactions between Vistra and the NRC project manager. These estimates are based on the NRC staffs initial review of the request and they could change due to several factors, including requests for additional information and/or unanticipated addition of scope to the review.
