BETWEEN U.S. NUCLEAR REGULATORY COMMISSION AND THE U.S.
ENVIRONMENTAL PROTECTION AGENCY, REGION 5 Signed by Martinez, Nancy on 12/20/24 On December 16, 2024, a teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) staff and the U.S. Environmental Protection Agency (EPA), Region 5. The purpose of the teleconference was to address comments EPA submitted to the NRC in a letter dated December 12, 2024 (Agencywide Documents Access and Management System ML24353A119), on the final EIS, NUREG-1437, Supplement 26, Second Renewal, Site-Specific Environmental Impact Statement for License Renewal of Nuclear Plants: Regarding Subsequent License Renewal for Monticello Nuclear Generating Plant, Unit 1, Final Report (ML24309A221). No members of the public were in attendance as this was a government-to-government meeting.
During the teleconference, NRC staff:
x Clarified that in October 2023, the applicant (Excel Energy) was not able to complete a northern wild rice survey (wild rice) given that peak growth period for wild rice is between July and early October. However, in August 2024, the applicant conducted and completed an ecology survey for wild rice within the Monticello site.

x Discussed that prior to the wild rice survey being conducted, in October 2023, Xcel Energy conducted initial reconnaissance and a site visit with representatives of the Mille Lacs Band of Ojibwe to identify potential habitat areas for wild rice within the Monticello site.
x Discussed that the Mille Lacs Band of Ojibwe reviewed the wild rice survey during a site visit in September 2024, and no concerns with respect to the survey were identified.
x Discussed that the NRC staff has consulted with other Tribes, including the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community. As part of consultation, a site visit was conducted in November 2024 with the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community.
x Discussed that Xcel Energy has updated its fleet procedure to notify and invite the Lower Sioux Indian Community, the Mille Lacs Band of Ojibwe, and the Shakopee Mdewakanton Sioux Community to the Monticello site to monitor any ground disturbing activities if they occur in areas of high potential for intact archaeological deposits. Staff also noted that there are no planned ground disturbing activities in the period of extended operation.
The EPA thanked the NRC staff for addressing the comments provided in their December 12, 2024, letter. During the teleconference, EPA stated that their comments have been resolved and have no further comments. On December 17, 2024, via email (ML24353A134), EPA approved the meeting summary with minor edits, confirmed that their comments were resolved, and had no further comments.
