Entergy - 2024 Certification of Foreign Ownership and Control or Influence (FOCI)

Arkansas Nuclear One, Units 1 & 2 Docket Nos. 50-313 & 50-368 License Nos. DPR-51 & NPF-6 Grand Gulf Nuclear Station, Unit 1 Docket No. 50-416 License No. NPF-29 River Bend Station, Unit 1 Docket No. 50-458 License No. NPF-47 Waterford 3 Steam Electric Station Docket No. 50-382 License No. NPF-38 This letter is the Entergy Operations, Inc., (EOI) 2024 submittal to provide annual certification that the board resolution to mitigate Foreign Ownership, Control, or Influence (FOCI) concerns remains in effect. In Reference 1, EOI submitted the 5-year request for FOCI redetermination.

The request was supplemented via the Reference 2 update to the Owners, Officers, Directors, and Executive Personnel forms. The NRC rendered the prior favorable FOCI review in January 2022 (Reference 3). Note that Entergy has reviewed NEI 18-11 (Reference 4) and determined that the 5-year request for redetermination is no longer necessary. At this time, Entergy will continue to provide an annual certification that the 2004 board resolution meant to negate or mitigate FOCI remains in effect.

EOI hereby certifies that the Board resolution adopted in 2004 (Reference 5) by EOI and Entergy Corporation (EC) remains in effect serving as insulation tools to ensure that EOI has been delegated full authority to act independently of the aforementioned parent organization (EC) in matters which relate to the responsibility of safeguarding classified information to which EOI has access. The resolution also ensures that EC will not have access to classified information being used or handled by EOI.
