HOPE CREEK GENERATING STATION, SALEM GENERATING STATION, UNITS 1 AND 2, AND PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 - EXEMPTIONS FROM THE REQUIREMENTS OF TITLE 10 OF THE CODE OF FEDERAL REGULATIONS, PART 50, SECTIONS 50.82(a)(8)(1)(A)

AND 50.75(h)(1)(iv) (EPID L-2024-LLE-0018)

Dear Charles McFeaters:

The U.S. Nuclear Regulatory Commission (NRC) has approved the enclosed exemptions from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Sections 50.82(a)(8)(1)(A) and 50.75(h)(1)(iv), for the Hope Creek Generating Station, Salem Generating Station, Units 1 and 2, and Peach Bottom Atomic Power Station, Units 2 and 3. This action is in response to your application dated May 28,2024, that requested exemptions from 10 CFR 50.82(a)(8)(i)(A) and 10 CFR 50.75(h)(1)(iv). Exemptions from these sections would allow PSEG Nuclear, LLC to transfer excess earnings from the nuclear decommissioning trust (NDT) fund into subaccounts in the NDT for decommissioning costs that do not fall under the definition of decommission in 10 CFR 50.2 without prior notification to the NRC. Specifically, the funds would be used for decommissioning costs as described by the U.S. Treasury Department in Title 26 of the CFR, Section 1.46A-1(b)(6). These costs include costs for radiological and non-radiological activities, including major radioactive component disposal, site restoration activities, and certain spent fuel management activities Pursuant to the National Environmental Policy Act of 1969, as amended, the NRC published an environmental assessment and finding of no significant impact in the Federal Register (FR) on December 20,2024 (89 FR 104236). As discussed in that Federal Register notice, the NRC determined that issuance of the exemptions will not have a significant effect on the quality of the human environment.

A copy of the exemptions is enclosed. The exemptions have been forwarded to the Office of the Federal Register for publication.
