1 U.S. Nuclear Regulatory Commission Public Meeting Summary November 27, 2024
Title:
The REAL ID Act: Considerations for NRC Nuclear Power Plant Licensees Meeting Identifier: 20241284 Date of Meeting: October 30, 2024 Location: Webinar Category of Meeting: Information Meeting with a Question-and-Answer (Q&A) Session.
Purpose of the Meeting: The purpose of this meeting was for the U.S. Nuclear Regulatory Commission (NRC) staff to meet with stakeholders to discuss regulatory and technical issues.
Attendees had an opportunity to ask questions of the NRC staff or make comments about the issues discussed throughout the meeting; however, the NRC was not actively soliciting comments towards regulatory decisions at this meeting.
The U.S. Department of Homeland Security (DHS) issued regulations to implement the requirements of the REAL ID Act in 6 CFR Part 37, "REAL ID Driver's Licenses and Identification Cards. In accordance with these DHS regulations, Federal agencies are scheduled to begin card-based enforcement of the REAL ID Act requirements on May 7, 2025.
This meeting was primarily intended for stakeholders implementing the personnel access authorization requirements applicable to NRC-licensed nuclear power plants under 10 CFR 73.56(d)(3), "Verification of true identity," and access control requirements applicable under 10 CFR 73.55(g)(7), "Visitors."
General Details: The meeting began at 3:02 p.m. EST. The meeting was attended by 105 individuals, including personnel from licensee sites, contractors and vendors, the Nuclear Energy Institute (NEI), the NRC, and the DHS Transportation Security Administration (TSA).
The majority of meeting attendees participated via Microsoft TEAMS, but several participated by teleconference. A list of attendees is included as an attachment to this meeting summary. The meeting ended at 4:22 p.m. EST.
Summary of Presentations: The NRC slide presentation consisted of an overview of the REAL ID Act of 2005 and requirements specific to entering nuclear power plants, provided information on REAL ID compliant and non-compliant identification cards and other acceptable forms of photographic identification, discussed the NRCs intention to issue a generic communication on this topic, and highlighted a DHS proposed rule on phased enforcement of the card-based requirements of the REAL ID Act. No stakeholders or members of the public made formal presentations, but meeting attendees did engage with NRC and TSA staff during the Q&A session of the meeting. The meeting was transcribed.
Action Items/Next Steps:
The NRC is developing an information notice addressing the implementation of REAL ID Act requirements and considerations for NRC nuclear power plant licensees. The NRC plans to issue this generic communication in early 2025.
2 NRC staff advised meeting attendees that DHS is considering a phased enforcement approach for Federal agencies, which would allow agencies to begin card-based enforcement of the REAL ID Act requirements as late as May 5, 2027. DHS issued a notice of proposed rulemaking on September 12, 2024 (89 FR 74137). If issued as final, the proposed rule would amend the requirements in 6 CFR Part 37 to allow for phased enforcement. The NRC is currently considering potential options for a phased enforcement plan. Such plan would need to be coordinated with DHS, and details on the plan would be made publicly available on the NRCs website.
The NRC is evaluating guidance in two NRC inspection procedures (71130.01, Access Authorization; and 71130.02, Access Controls) to determine if changes to the procedures may be needed to provide guidance to inspectors for assessing whether a licensees site-specific procedures include steps to confirm that any state-issued drivers licenses or identification cards, when used for purposes of entering a nuclear power plant, comply with the requirements of the REAL ID Act when card-based enforcement is in effect.
