SUBJECT:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR THE DIABLO CANYON NUCLEAR POWER PLANT, UNITS 1 AND 2 LICENSE RENEWAL (DOCKET NUMBERS: 50-275 AND 50-323)

Dear Chairwoman Charmaine McDarment:

The U.S. Nuclear Regulatory Commission (NRC) staff is issuing for public comment the draft supplemental environmental impact statement (DSEIS), NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 62, Regarding License Renewal of Diablo Canyon Nuclear Power Plant, Units 1 and 2. Diablo Canyon Nuclear Power Plant Units 1 and 2 (DCPP) is operated by Pacific Gas and Electric Company, and is located in San Luis Obispo, California. The NRC initiated consultation with your office regarding this project on January 24, 2024. In accordance with Title 36 of the Code of Federal Regulations (36 CFR) Section 800.8(c), the NRC staff has elected to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under Section 106 of the National Historic Preservation Act of 1966, as amended.

The NRC staff has prepared a DSEIS evaluating the environmental impacts of the proposed action, considered to be the renewal of DCPPs operating licenses for an additional 20 years.

The extended operation may have the potential to impact DCPPs National Register-listed Rancho Canada de Los Osos y Pecho y Islay archaeological district. The NRC has determined that the proposed action would result in no adverse effect to historic properties, as defined in 36 CFR 800.5(b), as there are no planned ground disturbing or refurbishment activities. The undertaking would also not adversely affect historic and cultural resources within the area of potential effect.

As discussed in the DSEIS, the NRC staffs preliminary recommendation is that the adverse environmental impacts of the license renewal are not so great that preserving the option for energy-planning decision-makers would be unreasonable. The DSEIS is available via the following link:

https://adamswebsearch2.nrc.gov/webSearch2/main.jsp?AccessionNumber=ML24299A167.

The DSEIS may also be obtained online in the NRCs Agencywide Documents Access and Management System (ADAMS) Public Documents collection at https://www.nrc.gov/readingrm/adams.html under ML24299A167. To begin the search, select Begin Web-based ADAMS Search. For problems with ADAMS, please contact the NRCs Public Document Room (PDR) reference staff at 1-800-397-4209, 301-415-4737, or via email to pdr.Resource@nrc.gov.November 1, 2024 Pursuant to 36 CFR 800.8(c), the NRC staff is requesting your comments on the DSEIS and preliminary recommendation by December 16, 2024. Written comments should be submitted by mail to:

ATTN: Program Management, Announcements and Editing Staff Office of Administration Mail Stop: TWFN-7A60M U.S. Nuclear Regulatory Commission Washington, DC 20555-0001 Electronic comments on the DSEIS may be submitted to the NRC by accessing https://www.regulations.gov/ and searching for Docket ID NRC-2023-0192; directly to DiabloCanyonEnvironmental@nrc.gov; or through the NRC staff email contacts listed below.

The NRC staff will hold an in-person public meeting on the DSEIS on November 20, 2024, from 6:00 p.m. - 9:00 p.m. Pacific Time (PT) at the Courtyard San Luis Obispo, 1605 Calle Joaquin, San Luis Obispo, CA 93405. The NRC staff is also planning a virtual meeting on November 14, 2024, from 10:00 a.m. - 1:00 p.m. PT. Both meetings will include a presentation on the preliminary findings and a transcribed public comment session. The public meeting details can be found on the NRCs Public Meeting Schedule at: https://www.nrc.gov/pmns/mtg.

If you have any questions concerning the NRCs license renewal review, please contact Jennifer Davis, Staff Archaeologist, by phone at 301-415-3835 or via email at Jennifer.Davis@nrc.gov, or Kim Conway, Environmental Project Manager, by phone at 301-415-1335 or via email at Kimberly.Conway@nrc.gov.
