U.S. NUCLEAR REGULATORY COMMISSION VERIFICATION LETTER AND PROPRIETARY DETERMINATION FOR GE-HITACHI LICENSING TOPICAL REPORT NEDC-33912P-A, REVISION 2, BWRX-300 REACTIVITY CONTROL
Dear Ms. Catts:
By letter dated February 17, 2023, GE-Hitachi Nuclear Energy Americas, LLC (GEH), submitted the revised approved version of Licensing Topical Report (LTR) NEDC-33912P-A, Revision 2, BWRX-300 Reactivity Control (-A) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23048A016), in support of a future licensing application for the GEH small modular reactor under Title 10 of the Code of Federal Regulations (10 CFR)
Part 50, Domestic Licensing of Production and Utilization Facilities.
This is a non-substantive revision to the GEH LTR NEDC-33912-A, Revision 1 submitted in a letter dated March 1, 2021 (ML21060B577), and approved by the NRC staff in a letter dated April 1, 2021 (ML21077A096). In its February 17, 2023, letter GEH described a format error of its sub-section numbers that do not affect the NRC staff findings documented in the NRC staff Final Safety Evaluation dated September 29, 2020 (ML20275A368).
, of the February 17, 2023, submittal, GEH included an affidavit (ML23048A019) with a request that the proprietary information contained in NEDC-33912P-A, Revision 2 (ML23048A017 proprietary version and NEDO-33912-A, Revision 1, ML23048A018 public version), be withheld from public disclosure pursuant to 10 CFR Part 2, Section 2.390. The staff previously evaluated the request for withholding on the same information as documented in a letter dated November 17, 2020 (ML20290A264) and has verified that the withholding determination remains valid.
Therefore, the revised -A version of the submitted LTR marked as proprietary, will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
The NRC staff has verified that the submitted revised -A, version is acceptable and is approved for referencing in future licensing applications for the BWRX-300 to the extent specified and under the limitations delineated.
If the NRCs criteria or regulations change so that its conclusion in this letter (that the LTR is acceptable) is invalidated, GEH and/or an applicant referencing the LTR will be expected to revise and resubmit its respective documentation or submit justification for the continued applicability of the LTR without revision of the respective documentation.
