Dear Mrs. Jones,
The U.S. Nuclear Regulatory Commission (NRC) received your request for an official jurisdictional determination dated May 20, 2024. The request is in regard to the Pressurizer Spray Valve being sold to Framatome in France, which will install the parts in question in the United Kingdom (U.K.) by Electricite de France. The Pressurizer Spray Valve Spray Valve is used to control the pressure and temperature of the pressurizer in the Pressurized Water Reactor (PWR) at Hinkley Point C in the U.K.
The NRC has reviewed Curtiss-Wrights assessment and analysis of the Pressurizer Spray Valve. After reviewing and consulting with the Department of Commerce, the NRC concluded the Pressurizer Spray Valve is not an especially design or prepared (EDP) component because the valve has non-nuclear applications outside the processing, use, or production of special fissionable material. Therefore, it does not fall within the jurisdiction of the NRC. Instead, it falls within the jurisdiction of the Department of Commerce.
