OF SEPTEMBER 5, 2024, PUBLIC MEETING WITH NUCLEAR ENERGY INSTITUTE TO DISCUSS POTENTIAL IMPROVEMENTS IN NUCLEAR REGULATORY COMMISSION STAFF GUIDANCE FOR POWER UPRATE REVIEWS (EPID L-2024-PPM-0004)
On September 5, 2024, a public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Nuclea r Energy Institute (NEI) virtually. The purpose of the meeting was for the NRC and NEI to discuss potential improvements in NRC staff guidance for power uprate reviews. The meeting notice and agenda, dated August 8, 2024, are available in the NRCs Agencywide Documents A ccess and Management System (ADAMS) at Accession No. ML24249A147. A list of attendees is provided in the enclosure.
NEI presented (ML24249A115) on the following topics:
ADVANCE Act - Opportunities to Enable Change.
Updating Power Uprate Guidance (Office of Nuclear Reactor Regulation (NRR) Office Instructions LIC-109 and LIC-500 regarding acceptance review procedures and the topical report process, respectively).
Examples of Power Uprate Combined License Applications.
Improving Efficiency Through the use of License Conditions.
Equipment Environmental Qualification (EQ) and Implementing Higher Burnup and Increase Enrichment.
The discussion focused on examples of bundled and linked amendments so that NRC staff can understand and identify what kind of bundled/linked amendments to expect and the best approach to review these types of applicat ions. The NRC staff and NEI came to a common understanding of licensees plans of bundling and/or linking planned license amendments requests, such as an extended power uprate (EPU) combined with application of Maximum Extended Load Line Limit Plus (MELLLA+) and a power uprate combined with a fuel transition.
Additionally, it was agreed that these plans should be discussed in pre-application public meetings and discussions would be documented in public meeting summaries.
NRC staff stated that they are in the process of considering the amount of margin that is included in EQ-related radiological calculations as well as reviewing current assumptions that are commonly used in EQ analyses. Staff is open to public discussions in early 2025 to provide insights into the staffs work and obtain feedback from stakeholders.
The NRC staff stated that they are open to future engagements with NEI (and industry) in areas where efficiencies may be gained such as bundled/linked amendment, expanded use of license conditions and leveraging the recently NRC-approved topical report on data validation and reconciliation for measurement uncertainty recaptures and other topical reports.
No regulatory decisions were made during the meeting. No public meeting feedback or feedback forms were received.
There was one comment from a member of the public.
Edwin Lyman of the Union of Concern Scientists asked about if members of the public would get another opportunity to review a license conditi on after it is implemented. NRC staff responded that if a license condition is included as part of a license amendment, there is no other public involvement to review after implementation of the license condition.
