OF SEPTEMBER 30, 2024, MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND THE yak tityu tityu yak tiłhini NORTHERN CHUMASH TRIBE On September 30, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held a virtual meeting with representatives from the yak tityu tityu yak tiłhini Northern Chumash Tribe (YTT) related to the proposed license renewal (LR) for Diablo Canyon Power Plant Units 1 and 2 (Diablo Canyon). The YTT are a consulting party for the Diablo Canyon LR. A list of NRC and YTT attendees is provided at the end of this summary.

The meeting began with the introduction of Jennifer Davis, NRCs senior archaeologist, as the new Section 106 lead for the Diablo Canyon LR. The NRC staff also confirmed that the information requested by the YTT in April 2024 (i.e., surveys, maps, and photos) had been provided by Pacific Gas and Electric Company (PG&E). The NRC staff provided a brief process overview and described how it uses information in the applicants environmental report (ER) as a starting point in the preparation of its supplemental environmental impact statement (SEIS) for the LR action. The NRC also provided a schedule with safety and environmental milestones for the Diablo Canyon LR.

During the meeting, the YTT walked through recommendations related to their review of PG&Es ER, which was submitted on November 7, 2023 (ML23311A154). The YTT offered several recommendations related to wording in the ER, provided clarifications on historical discussions, and identified areas where they believe information should be reviewed for accuracy or updated to reflect recent documentation related to the YTT and Diablo Canyon Lands (i.e., 2018 State designation and 2020 Johnson ethnographic study). The YTT also shared its desire for an update to the 1982 access agreement to reflect the current practice for notifications. Finally, the YTT provided general comments related to the consideration of the YTT in the areas of environmental justice and socioeconomics.

The NRC staff explained that it will consider the YTTs comments provided during the meeting as it prepares its draft SEIS for the Diablo Canyon LR; however, due to time constraints with an anticipated issuance in October 2024, some additional edits may be incorporated between draft and final SEIS stages. The NRC also noted that the availability of the draft SEIS will initiate a 45-day public comment period, during which the YTT will be invited to provide formal comments to the NRC.
