MEMORANDUM AND ORDER (Regarding Replies to Petitioners Response to NRC Staff Motion Concerning Redacted Documents)

The Licensing Board is in receipt of a September 30, 2024 response by petitioners

Beyond Nuclear, Inc., and the Sierra Club, Inc., (collectively Petitioners) to the Nuclear

Regulatory Commission (NRC) Staffs September 25, 2024 motion requesting that the Board

accept and place on the public docket of this proceeding redacted versions of documents

previously identified as potentially containing nonpublic information. 1 The response, which

do[es] not currently contest the merits of the redactions, instead poses a series of questions

about the NRC Staffs process for reviewing the documents to determine whether they

contained any nonpublic information, including the role the Federal Energy Regulatory

Commission (FERC) in that process. Petitioners Response to Staff Motion at 1-3.

While replies to an answer to a motion are not permitted absent leave from the presiding

officer, see 10 C.F.R. § 2.323(c), given the seemingly unforeseen nature of the assertions

raised in Petitioners response, we will prov ide the NRC Staff (and applicant Duke Energy

Carolinas, LLC, if it wishes to do so) with the opportunity to file a reply to Petitioners

September 30, 2024 response, which must be submitted on or before Monday, October 7,

2024.2
