MEMORANDUM (Second Notice Regarding Issuance of Decision)
Pursuant to 10 C.F.R. § 2.309(j)(1), the Licensing Board hereby advises the
Commission and the participants to this proceeding that the issue of the proper treatment of
potential nonpublic information in this proceeding continues to delay the issuance of a Board
decision on the pending hearing request of petitioners Beyond Nuclear, Inc., and the Sierra
Club, Inc. (collectively Petitioners). The Board will now endeavor to issue that decision on or
before Friday, October 18, 2024.
As the Board noted previously, however, the proper treatment of potential nonpublic
information is an evolving matter that may engender further delay in the issuance of a Board
decision regarding Petitioners hearing request. See Licensing Board Memorandum (Notice
Regarding Issuance of Decision) (Aug. 8, 2024) at 1 (unpublished). Since mid-August, the
Board has issued two protective orders regarding potential Sensitive Unclassified
Non-Safeguards Information (SUNSI) that may be associated with documents in this

proceeding,1 which currently are the subject of clarification/reconsideration motions from both
applicant Duke Energy Carolinas, LLC (Duke) and the Petitioners. 2 Additionally, on or before
September 11, 2024, the Board anticipates re ceiving from the NRC Staff a comprehensive
status report regarding its efforts to provide redactions of the nonpublic information subject to
the protective orders and an estimated date when it will complete this task. 3
The Board will apprise the Commission and the participants should circumstances make
further delay in the issuance of the Boards decision necessary.
