In the existing final rule under § 73.1215(d)(1)(iii) for reporting suspicious activity, we have included manned aerial activity, and unmanned aerial activity.

If by manned we mean crewed by humans, then unmanned could be interpreted as meaning either uncrewed or crewed by non-humans.

If so, we might argue that the current reg requires reporting of aerial phenom that will meet the NDAA.

In looking at Daryls slide on the NDAA language, I have two questions.

1. Does the description of what is reported under § 73.1215 today match what the NDAA wants.
1. Can the Commission exclude certain types of licensees from the group or other sites or facilities regulated by the Nuclear Regulatory Commission in a rulemaking. Meaning does this NDAA language include all NRC licensees, e.g., RTR, NPUF, and byproduct licensees? Or can the Commission via rulemaking specify which licensees are not included. § 73.1215(d) includes RTRs. Also what about agreement state licensees, especially those subject to §

73.67?

Does the current rule require licensees to report UFOs? I think this goes without saying, but if its not explicitly required, using the RG to expand the scope of the rule is a non-starter.

Lets definitely talk before doing anything beyond what we currently have planned for the RGs (i.e., specifically addressing the known issues). I think trying to expand the scope has the potential to derail things.

UAP/UFO Reporting Requirement and EWR Guidance - A question

BLUF: The NRC is now required to report the number of unidentified anomalous phenomena (UAPs, also previously referred to as UFOs) at/around NRC-licensed facilities on an annual basis, per this years NDAA. DSO/SOSB believes there is a gap in our current guidance to licensees about suspicious activity reporting, because our previously issued IAT/SA guidance focuses on unmanned aerial systems (and not UAPs/UFOs). They are looking to address that gap.

Initially, DSO/SOSB intended to communicate this shift in guidance through a Security Advisory, which is how guidance regarding suspicious activity reporting has been communicated previously.

However, with the issuance of the Enhanced Weapons Rule this spring and the shift in suspicious activity reporting from a voluntary initiative to a regulatory requirement, I believe communicating this guidance would be better placed in the RGs (and - how convenient! - we are in the process of revising the RGs for the EWR).

My question to the team is: Is making this addition to include UAP/UFO reporting in the RGs at this time appropriate (and/or necessary), or should we pursue the plan that was initially proposed by DSO/SOSB, and issue a generic communication to this effect? This is basically another example of suspicious activities that should be reported per the rule.
