Dear Daniel Ashworth:

The U.S. Nuclear Regulatory Commission (NRC) staff has received the submittal from BWXT Nuclear Operations Group, Inc. - Lynchburg, dated June 25, 2024, transmitted by Letter 24-030, that requests NRC approval of proposed amendments to the Fundamental Nuclear Material Control Plan, Chapter 1 of the License Application, and license condition SG-5.6 of SNM-42. The incoming cover letter is not publicly available due to the sensitive security-related information contained therein. The enclosure to the cover letter is also not publicly available because of its classified designation.

We have completed our acceptance review of the submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed review. The submittal has been assigned Enterprise Project Identifier (EPID) L-2024-LLA-0094. Please reference this EPID number and Docket Number 70-27 in any future correspondence associated with this request.

Please note that the NRC staffs technical review of the submittal may identify issues that require additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review by December 30, 2024. This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule. In addition, the NRC staff estimates that completing the review of the submittal will require up to 60 staff hours, which corresponds to about $19,020.00 ($317.00/hour).

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available for public inspection in the NRC Public Document Room (PDR) or electronically from the Publicly Available Records System component of the NRCs Agencywide Documents Access and Management System (ADAMS). The PDR is currently open Monday-Friday by appointment only.
