RE: Drones/Unidentified Aerial Phenomena (UAP) reporting requirements Hi Kathleen, Like Canada, the NRC's regulations do not specifically address UAS' (or UAPs). Currently, reporting of suspicious activity is voluntary. Once the final enhanced weapons rule goes into effect, there will be a new section in Chapter 10 of the U.S. Code of Federal Regulations (CFR) § 73.1215 codifying requirements with a goal of consistent, timely reporting to local law enforcement agencies (LLEAs), the Federal Bureau of Investigations (FBI), and the NRC. Appendix A of the new Regulatory Guide 5.87 "Suspicious Activity Reports Under 10 CFR Part 73", will be published with the final rule and will provide examples and guidance on suspicious activity reporting, including aviation-related activities.
SA-2021-06 is not responsive to UAP data call
Unfortunately, we cannot share the contents of the final RG 5.87 until the rule package is published.
However, the approved regulatory text for§ 73.1215 "Suspicious activity reports", is publicly available (starting on the bottom of page 135) in the enclosure to the Staff's Requirement Memorandum for the Commission Paper "SECY-18-0058." It is attached to this email as a pdf: ML22027A387.
We are also providing our most recent Security Advisory (SA) on these types of events "SA 2021 -06 Updated Voluntary Reporting Guidelines for Suspicious Flyover Activity-UAS".
Please note and acknowledge that SA 2021-06 is marked as an NRC "Official Use Only-Security Related Information SRI)" document. As such, CNSC handling of it is subject to Sections I "Information to be Exchanged",Section II "Excepted Information", and Section Ill "Use of Information and Allocation of Intellectual Property Rights" of the 2017 Memorandum of Understanding between the USN RC and the CNSC for the Exchange of Technical Information and Cooperation in Nuclear Safety Matters.

For example, our reporting requirements are for attempted or actual breaches of security or attempted or actual acts of sabotage, including credible threats made against an NPP. Our reporting requirements are not specific to drones or UAPs per se. It would be useful for us to know how your reporting requirements are expressed regarding t hese events.

I just learned from someone in our security office that indeed this subject came up in recent talks with your folks.
Dustin Slaughter is a frequent Freedom of Information Act requester. Most of his work, I believe, has been on drones over our NPPs, but he now seems interested in flying saucers. He may be working with Mr. Otis, or perhaps in competition with him.
Anything you can send today would be appreciated. After that, we have a holiday on Monday.
And my apologies - my boss had forwarded me an email several days ago asking me to reach out to your folks on this subject. Lisa Donnelly and Wayne Gratton were on the email, as well as Kathleen Heppell-Masys in your security office.

Monday is a federal holiday, and I suspect Sunday being Father's Day may also contribute to all the "Out of Office" replies I received trying to develop an answer for you. In a general sense, I can tell you that we have had sightings of Unmanned Aerial Systems (UAVs - ie., drones) over U.S. nuclear power plants, but no UAPs - or more colloquially, flying saucers. We request our licensees to report any suspicious overflights to us. This currently is voluntary, but we are developing a new regulation that would make it a requirement to report a suspicious overflight of any kind.
