Background:

On June 5, 2024, a public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Kairos Power, LLC (Kairos) (ML24165A242). The purpose of that meeting was to discuss the foundation design for the Hermes 1 test reactor. Kairos representatives described the proposed foundation construction design concept of drilled piers socketed into sound rock. This differed from the foundation design described in the Hermes 1 preliminary safety analysis report (PSAR) in which the foundation mat rested on a concrete fill over the sound rock after an open excavation of the site. Kairos representatives also discussed the inspection and testing that will be implemented to meet the following geological mapping condition in the Hermes 1 construction permit (CP).

Kairos shall perform detailed geologic mapping of excavations for safety related engineered structures; examine and evaluate geologic features discovered in those excavations; and notify the Director of the Office of Nuclear Reactor Regulation, or the Directors designee, as specified in 10 CFR 50.4, Written communications, once excavations for safety related structures are open for examination by the NRC.

Meeting Summary:

On July 18, 2024, a virtual partially closed observation meeting was held to continue the discussion of the Hermes 1 foundation. The NRC staff described expectations for how the permit condition could be met given the new foundation design (ML24197A172).

Below is a summary of the comments and discussions:

Kairos representatives commented that the NRC staffs expectations are clear. Kairos will map each socket during construction for geologic features and make the information available to the NRC staff.

The NRC staff presentation stated that a [f]ence diagram or other correlation of geologic units and features in the subsurface and available geophysical information should be provided to identify subsurface features between adjacent piers. Kairos representatives asked for clarification about the phrase and available geophysical information. The NRC staff responded that should Kairos perform any additional geophysical surveys in the future those results should also be shared with the NRC staff.

Kairos representatives noted that the permit condition only requires that the NRC be notified and does not include construction hold points for the NRC staff review and approval. The NRC staff agreed with that description and noted that early engagement with the NRC staff would be helpful to ensure staff resources are available when the information becomes available.

The NRC staff noted that a regulatory audit would be used as the mechanism for reviewing the information gathered from the geologic mapping condition.

The NRC staff commented that the focus of the staffs review would be on the geologic features that could challenge any staff conclusions in the safety evaluation of the Hermes 1 CP.
