SUMMARY

OF THE NUCLEAR REGULATORY COMMISSION WORKSHOP ON VENDOR OVERSIGHT On June 13, 2024, the Office of Nuclear Reactor Regulation (NRR), Division of Reactor Oversight (DRO), hosted the Nuclear Regulatory Commission (NRC) Workshop on Vendor Oversight in Baltimore, Maryland. This workshop followed the Nuclear Procurement Issues Committee (NUPIC) vendor meeting to enable maximum participation by suppliers to the nuclear industry. The NRC Vendor Workshop included a keynote address by the Deputy Director, Division of Operating Reactor Licensing, Aida Rivera-Varona, as well as presentations by members of the NRC staff, NUPIC, the Electric Power Research Institute (EPRI), the American Society of Mechanical Engineers (ASME), the National Board of Boiler & Pressure Vessel Inspectors, authorized inspection agency (AIA), reactor licensees and nuclear vendors.

This was the 9th Workshop on Vendor Oversight.

The Workshop on Vendor Oversight included a plenary session on such issues as the control of items under Appendix B to 10 CFR Part 50; NRC safety culture; and safety conscious work environment (SCWE) guidelines for vendors. The workshop also included afternoon panel discussions about navigating part 21 and presentations of the different roles of ASME, NB, AIA, and NRC play in the oversight of ASME components.

The audience included approximately 350 attendees representing companies and organizations from 9 countries including vendors, industry groups, government regulatory agencies, and both foreign and domestic utilities.

A list of attendees is provided in Enclosure 1. The list of speakers is provided in Enclosure 2.

Morning Plenary Session The 9th NRC Workshop on Vendor Oversight began with Ms. Kerri Kavanagh, Chief, Quality Assurance and Vendor Inspection Branch (IQVB) providing safety and logistical expectations for the workshop. Ms. Kavanagh introduced Mr. Russell Felts, Director, Division of Reactor Oversight (DRO) in the Office of Nuclear Reactor Regulation (NRR), for the opening remarks.

Mr. Felts welcomed the attendees of the 2024 Workshop and provided remarks about the NRCs mission and principles of good regulation, as well as the importance of the nuclear supply chain. Mr. Felts introduced the keynote speaker Ms. Aida Rivera-Varona, the Deputy Director for Division of Operating Reactor Licensing in NRR.

Ms. Aida Rivera-Varona provided the keynote address from her perspective from nearly 30 years at the NRC. She highlighted the coordination between the NRC staff and the nuclear industry to ensure adequate oversight of vendors was executed during the COVID-19 public health emergency in early 2020, the importance of the NRCs mission in providing reasonable assurance of public health and safety, promoting the common defense and security, and protecting the environment, and how quality assurance programs are essential to delivering high quality SSCs to the nuclear industry. She defined safety culture and discussed the contribution of safety culture to Safety Conscious Work Environment (SCWE). Ms. Rivera-Varona encouraged vendor workshop discussions and urged vendors to ask questions to the staff throughout the day. Ms. Rivera-Varona was also recognized for her leadership in the coordination of the first NRC Workshop on Vendor Oversight in 2008. The keynote was followed by presentation from Mr. Marc Tannenbaum from the Electric Power Research Institute (EPRI).

Mr. Marc Tannenbaum, Principal Technical Executive, EPRI, presented the historical background on Appendix B to 10 CFR Part 50, and the basis for Commercial Grade Dedication (CGD) in 10 CFR Part 21. Mr. Tannenbaum expressed that CGD is an alternative process for accepting a commercial product. He noted that dedication is not a shortcut and the basis of the four methods is found in Criterion VII of Appendix B to 10 CFR Part 50. Mr. Tannenbaum discussed how CGD, as a process, is intended to provide adequate confidence or reasonable assurance that the dedication is equivalent to an item designed and manufactured under an Appendix B quality assurance program. Mr. Tannenbaum highlighted the important aspects to consider when determining whether to procure an item that was designed and manufactured to an Appendix B quality assurance program or to procure the item as commercial grade and perform CGD.

The morning session on NRC Safety Culture & Safety Conscious Work Environment Guidelines for Vendors included presentations from the three panel members of the NRC staff:

Ms. Carleen Parker, Mr. Odunayo Ayegbusi, and Mr. George Khouri.

Ms. Carleen Parker, Allegation Coordinator, Office of Enforcement, provided a discussion of safety culture and SCWE. Ms. Parker informed the audience of the NRC policy on safety culture, and reminded that the policy is not a regulation, however, is a collective commitment which should include suppliers and vendors. The presentation included NRCs definition of nuclear safety culture, safety culture traits, safety culture common language initiative, NRCs

K. Kavanagh approach to safety culture, input to the Reactor Oversight Process, event and allegation follow-up, and chilling effect letters.

Mr. Odunayo Ayegbusi, Reactor Operations Engineer, NRC, extended the safety culture topic with a case study on the safety culture challenges at the Chicago Bridge and Iron Lake Charles (CB&I LC) (formerly known as Shaw Modular Solutions) facility and its impact on the quality of items supplied to AP1000 construction sites.

Mr. George Khouri, Construction Project Manager in the Division of Construction Oversight (DCO), Region II, closed the morning session with a presentation on the Safety Culture Issues at Lake Charles Module Fabrication Facility and its impact on Vogtle and VC Summer AP1000 Construction Sites. Overall, the safety culture issues at Lake Charles facility caused a 4-year delay in the construction of the Vogtle AP1000 units.

Panel Session A: Navigating Part 21 Mr. Frankie Vega, Reactor Operations Engineer, NRC, moderated the session, provided opening remarks; and introduced the speakers for the first afternoon panel session.

Mr. Aaron Armstrong, Reactor Operations Engineer, NRC provided a presentation highlighting important practices for navigating Part 21. Mr. Armstrong described reporting requirements under Part 21 including the reporting timeline, responsibilities and described the reporting entitys ability to use other regulations to meet the Part 21 regulation. Mr. Armstrong also provided an overview on Part 21 electronic reporting requirements.

Mr. Earl Mayhorn, Principal Engineer, Ameren (Callaway Energy Center) presented NUPICs perspective on Part 21. Specifically, Mr. Mayhorn presented important Part 21 aspects covered during the NUPIC joint utility audits, provide an overview of Part 21 reporting avenues and presented several examples of common NUPIC joint utilities audit findings.

Mr. Jeffrey Kaar, Supervisor, Supplier Quality, Pacific Gas & Electric presented on utilities perspective on Part 21. Mr. Kaar presented background information on Part 21, described the process used by PG&E when implementing Part 21 and provided several examples, specific to PG&E, of lessons learned when implementing Part 21 requirements.

Mr. Dan Roberts, Quality Manager, Engine Systems, Inc. (ESI) presented on Part 21 from a vendor perspective. Specifically, Mr. Roberts described ESIs Part 21 implementation process and provided several examples in which ESI had implemented Part 21 requirements.

Mr. Dong Park, Reactor Operations Engineer, NRC, provided an overview of NRCs Technical Review Group (TRG) 21. Mr. Park provided an overview of the NRCs Operating Experience (OpE) and TRG programs. Mr. Park described the specific roles and responsibilities of TRG 21 and explained its value within NRCs oversight function.

Track B: ASME-Oversight and Conformity Assessment Ms. Andrea Keim, Reactor Operations Engineer, NRC, moderated the session, provided opening remarks, and introduced the speakers for the Track B session.

Mr. Yamir Diaz-Castillo, Reactor Operations Engineer, NRC, presented on the NRCs recognition of ASMEs Conformity Assessment Process. Mr. Diaz-Castillo discussed the NRCs

K. Kavanagh participation in consensus codes and standards and the legal basis. Mr. Diaz-Castillo introduced ASMEs Conformity Assessment process, the supporting exchange of correspondence, and how it is endorsed by the NRC through Information Notice (IN) 86-21 Recognition of American Society of Mechanical Engineers Accreditation Program for N Stamp Holders.

Mr. Michael Lockwood, Vice President Code Services, Hartford Steam Boiler, presented on usage of ASME B&PV Code by industry and foreign countries, and advantages to certification to the purchaser and regulator. Mr. Lockwood presented on the goals of ASME Conformity Assessment and aspects expected to be present in written processes, training, and quality checks. Mr. Lockwood introduced ASMEs Nuclear Certification Program - Applicant Information Handbook as a resource to parties interested in becoming Certificate Holders. Mr.

Lockwood also reviewed the process that certificates are issued by and the types of certificates available.

Mr. Edgar Whittle, Director, Codes & Standards, Bureau Veritas Inspection and Insurance Company, presented on the role of Authorized Inspection Agencies (AIA). Mr. Whittle discussed the basis of qualifications of AIAs from ASME QAI-1-2023 Qualifications for Authorized Inspection and the basis from ASME B&PV Code. Mr. Whittle presented on the requirements for accreditation of an AIA and additional responsibilities. Mr. Whittle also presented on the duties of Authorized Nuclear Inspector Supervisors and Authorized Nuclear Inspectors. Mr. Whittle presented on the role of AIAs as they relate to Owners Certificates, highlighting that only one Owner Certificate is active.

Mr. Gary Scribner, Assistant Executive Director-Technical, the National Board of Boiler and Pressure Vessel Inspectors (NBBI), presented on the relationship between the NRC, ASME, AIA, and the NBBI. Mr. Scribner presented on the qualifications for authorized inspectors, including required experience, examinations, and specific endorsements. Mr. Scribner discussed operational and administrative activities of Authorized Inspectors, including duties, the inspector diary, code of ethics, and resolution of complaints.

NRC Regulatory Updates and Closing Remarks Ms. Kerri Kavanagh provided gave closing remarks and opened the floor for questions to be answered by senior NRC staff.

Summary and Conclusions Several key messages were developed from the interactions during the workshop:

Rigorous quality assurance and vendor oversight is important to maintaining the integrity of the global supply chain and nuclear safety. The primary responsibility for oversight lies with licensees and vendors with regards to their suppliers.

Safety culture enhances overall quality by the raising of safety concerns that need to be corrected. Poor safety culture can result in NRC enforcement action. A robust and positive safety culture promotes quality in the global supply chain.

Ensure Appendix B to 10 CFR Part 50 and 10 CFR Part 21 are imposed in procurement documents. Otherwise, the procurement is not different from procuring a commercial grade item. Original Equipment Manufacturers, for components which they have design control, may transform a product into a safety-related structure, system, or component

K. Kavanagh (SSC) through the controls within their Appendix B quality assurance program, without the need to procure subcomponents safety-related or dedicate them.

All parties are required to have procedures to evaluate deviations and failures to comply.

While there are alternatives to meeting the Part 21 reporting requirements within regulations, i.e., 10 CFR 50.72/73, all the information required for a Part 21 report must be submitted. Coordination between vendors and licensees in Part 21 reporting is a best practice.

The NRC is able to incorporate ASME BP&V Code by reference and endorse ASMEs Conformity Assessment process through IN 86-21 through the agencys active involvement in consensus standard development and observance of Conformity Assessment activities.

Consistent with the previous vendor workshops, the NRC staff received many questions throughout the day and responded to these questions during the designated question and answer time, as well as the final plenary session at the close of the workshop. Interested parties who sought further clarification on any of the topics discussed during the workshop were encouraged to utilize the Frequently Asked Questions section of the NRC public website, or to contact Michael Fitzgerald at Michael.Fitzgerald@nrc.gov to solicit more detailed responses.

To enhance the next vendor workshop, the NRC solicited suggestions from the attendees. The NRC included a solicitation for suggested topics at future workshops in the workshop program.

NRC Public Meeting Feedback forms were also distributed to attendees, and a few public meeting feedback forms were received at the close of the workshop. In general, the attendees expressed interest in the NRCs continued conduct of similar outreach activities and suggested that the NRC continue to coordinate its workshop with the annual NUPIC Vendor Meeting.

Additional feedback forms are expected by mail. These feedback forms will be used to improve future vendor workshops and to focus on the appropriate topics at future workshops.

In summary, the workshop brought together regulated utilities, government agencies, nuclear component vendors, and other interested stakeholders to discuss such issues as producing components under an Appendix B quality assurance program, SCWE, Part 21 evaluations and reporting and ASME Conformity Assessment.
