By letter dated June 5, 2024 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML24158A004), Vistra Operations Company LLC (Vistra, the licensee) submitted a request for relief (RA-A1) from certain requirements of the ASME Boiler and Pressure Vessel Code Section XI during the Davis-Besse Nuclear Power Station, Unit No. 1 (Davis-Besse). The request applied to the fourth 10-year inservice inspection interval, and RA-A1 provided the basis for the determination that the inservice examination of certain welds were determined to be impractical.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC, or the Commission) staffs acceptance review of the proposed request. The acceptance review was performed to determine whether the scope and depth of the technical information was sufficient to allow the NRC staff to complete its detailed technical review. The acceptance review also intended to identify within the request any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing bases of the plant.

Pursuant to Section 50.55a(g)(5)iii of Title 10 of the Code of Federal Regulations (10 CFR),

determinations of impracticality must be based on the demonstrated limitations experienced when attempting to comply with the Code requirements during the inservice inspection interval for which the request is being submitted.

Pursuant to 10 CFR 50.55(a)(g)(6)(i), the Commission may grant relief for impractical ISI requirements and may impose alternative requirements as it determines are authorized by law, both of which will not endanger life or property or the common defense and security, and are otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the facility.

The NRC staff has reviewed Vistras request and concluded that it provided technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the request in terms of regulatory requirements.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in Vistras request, the NRC staff has estimated that this request will take approximately 130 hours0.0015 days <br />0.0361 hours <br />2.149471e-4 weeks <br />4.9465e-5 months <br /> to complete and that the review can be completed within 12 months (i.e.,

by June 18, 2025). If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during routine interactions between Vistra and the NRC project manager. These estimates are based on the NRC staffs initial review of the request and they could change due to several factors, including requests for additional information and/or unanticipated addition of scope to the review.
