APPROVAL OF UPDATES TO THE GLOBAL LASER ENRICHMENT LLC STANDARD PRACTICE, PROCEDURE PLAN TO REMOVE THE FUELS GROWTH ENGINEERING HEADQUARTER BUILDING (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-20214-SPR-0002)

Dear Tim Knowles:

The U.S. Nuclear Regulatory Commission (NRC) staff received an application from Global Laser Enrichment LLC. (GLE) for approval of its revised Standard Practice Procedures Plan (SPPP) by letter dated July 16, 2024 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML24199A106) and supplemented on September 17, 2024 (ML24261B962). The revised SPPP would remove the GLE Fuels Growth Engineering (FGE) building, as an approved NRC cleared area, and describe the classified matter controls implemented at the Test Loop (TL) facility.

The NRC staff conducted a review of the revised SPPP. The NRC staff also held a limited number of informal technical calls to seek clarification on the revised SPPP.

The SPPP Security Evaluation Report (SER) is provided in enclosure 1. The review included an environmental assessment of the plan updates, consistent with the requirements in Title 10 of the Code of Federal Regulations (10 CFR) Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The SPPP for removing the FGE head quarters building is required under 10 CFR Part 95 and does not involve a license amendment.

Therefore, the proposed revisions do not meet the criterion for categorical exclusion from an environmental assessment provided in 10 CFR 51.22. The NRC staff developed an environmental assessment resulting in a finding of no significant impact documented in enclosure 2, which was published as a notice in the Federal Register.

Enclosure 1 transmitted herewith contains security related information. When separated from enclosure 1, this letter and enclosure 2 are decontrolled.

The NRC staff finds that the revised SPPP reflecting the removal of the FGE building satisfies the applicable requirements of 10 CFR Part 25, 10 CFR Part 95, and 32 CFR Part 117. The review is documented further in the non-public security evaluation report in Enclosure 1.

Therefore, SPPP GLEP-00100-R, Revision 4 dated September 10, 2024 (ML24261B962, non-public), is approved.

The NRC staff estimates that this action required approximately 15.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br /> of review, which corresponds to about $4,898 ($316.00/hour). These hours were charged to the following Enterprise Project Identification Numbers (EPID) 000224/07007033/L-2021-SPR-0002, "GLE Security Reviews. This EPID will remain open once this review has been completed.

In accordance with 10 CFR Part 2 Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
