This is to follow-up and document our May 3, 2024, virtual call to request clarification to one of Purdues, March 25th, 2024, responses (Agencywide Documents Access and Management System (ADAMS) Accession Number ML24086A458) to the U.S. Nuclear Regulatory Commission (NRC) staff request for additional information (RAI) dated February 23, 2024 (ML24032A472), regarding written procedures for material control and accounting (MC&A).
During the call, the NRC staff informed you that, based on its assessment of the response to question number MC&A-5, Purdue had not adequately responded to or addressed the NRC staffs concerns. The NRC staff determined that the response did not confirm or assert whether Purdue had established, maintained, and followed written MC&A procedures that are sufficient to enable them to account for the special nuclear material in its possession in accordance with the requirements in 10 CFR 74.19(b). The staff wanted clarification to the RAI response that would confirm that actual written procedures exist at Purdue for conducting the MC&A activities in accordance with the NRC regulations.
During the discussion, you stated that Purdue maintains a software (Environmental Health and Safety Assistance - EHSA) that assists Purdue staff through reminders of when a specific MC&A activity needs to be performed but that these reminders do not actually describe a process for how to conduct the activity. The NRC staff noted that Purdues reminders do not actually meet the requirements and, as such, you committed to develop the procedures and have those available for NRC staff inspection when requested.
We request that you supplement Purdues response to RAI MC&A-5 via letter to me (see address below) confirming the information discussed during the call and discussed above. Please include any additional clarification to the RAI response that you may consider necessary to address the identified deficiency.
