AEROTEST OPERATIONS, INC. - ACKNOWLEDGEMENT OF RESPONSE TO NRC INSPECTION REPORT 050- 00228/2023- 001 AND NOTICE OF VIOLATION

Dear David Slaughter:

On August 24, 2023, the U.S. Nuclear Regulatory Commission (NRC) issued NRC Inspection Report 050-00228/2023- 001 (Agencywide Document and Access Management System (ADAMS) Accession No. ML23219A188) with an enclosed Notice of Violation to Aerotest Operations, Inc. You responded to the inspection report by letters dated September 9, 2023 (ML23255A036 and ML23255A034), and October 2, 2023 (ML23279A106), and disputed one of the Severity Level IV violations and the minor violation (EA-23-118).

The disputed Severity Level IV violation involved failure to maintain in effect and fully implement all provisions of the NRC-approved Certified Fuel Handler Training and Requalification Program. In accordance with Section 2.8 of the NRC Enforcement Manual, the NRC reviewed your basis for contesting the violations. Accordingly, we provided the results of our evaluation by letter dated February 5, 2024 (ML24025A167) that concluded the original violation remained valid. However, the staff revised the Severity Level IV violation to enhance its clarity and modified the dates of noncompliance and reissued the inspection report on February 8, 2024 (ML24039A038).

In your letter dated February 27, 2024 (ML24061A023), you accepted the violation regarding the failure to maintain in effect and fully implement all provisions of the NRC-approved Certified Fuel Handler Training and Requalification Program. I contacted you by phone on April 25, 2024, to discuss your response letter and gain additional perspectives for the actions described. You followed up our phone conversation by email dated that same day to emphasize that you accepted the violation and actions taken to correct the condition (ML24123A241). After reviewing the information provided in your response letter, our phone conversation, and follow-up email, we have concluded that your completed and proposed corrective actions appear to adequately address the regulatory noncompliance as described in the Notice of Violation. We will review your implementation of these corrective actions during a future inspection to determine whether full compliance has been restored and whether compliance will be maintained.
