SUMMARY
OF APRIL 9, 2024, FUEL CYCLE CONSTRUCTION INSPECTION PROGRAM PUBLIC MEETING The staff of the U.S. Nuclear Regulatory Commission (NRC) conducted a hybrid meeting (in-person and virtual via Microsoft Teams) with representatives of the Nuclear Energy Institute (NEI), licensees and applicants in the fuel facility industry, and members of the public on April 9, 2024. The purpose of the meeting was for the NRC staff to meet with NEI, the nuclear fuel facility industry, and stakeholders to discuss feedback received during the January 11, 2024, public meeting and how it is considered for proposed revisions of inspection guidance, and tabletop examples of potential inspection activities/attributes for management measures during construction and operational readiness reviews (ORRs).

Meeting Summary:
The meeting began with the NRC providing an overview of the meetings purpose and logistics. Opening remarks were made by Shana Helton, Director, Office of Nuclear Material Safety and Safeguards (NMSS), Division of Fuel Management.
After opening remarks, the NRC staff provided a series of presentations followed by question-and-answer sessions. The presentations covered the NRCs response to several feedback topics from the January 11, 2024, public meeting. The topics pertained to safety significant items and services, timing and development of principal inspection plan, comments on construction inspection procedures (IPs),
and implementation of management measures (MMs) during construction and ORRs.
Closing remarks were given by Anthony Masters, Director, Division of Fuel Facility Inspection (DFFI),

Below is a summary of topics discussed by the staff:
- Definition of major modifications for existing licensees and estimate of inspection hours.
- Use of the term at-risk open items during at-risk construction activities.
- Safety significant items and services as it pertains to regulatory requirements in a license, including integrated safety analysis and items relied on for safety (IROFS) language.
- Timing and development of principal inspection plan with respect to start of at-risk construction and major modifications.
- Several clarifications pertaining to the construction IPs that were presented, during the public meeting, on January 11, 2024.
- Implementation of MMs during construction verses operations and applicable NRC inspections; specifically, how MMs relate to construction of IROFS, flow down of MMs to subcontractors, and training and qualifications MMs during construction verses IROFS training requirements for operators, as applicable.
- New ORR IPs with transparent fee-billing reporting and licensee readiness for ORR inspections.
