By letter dated March 8, 2024, GE-Hitachi Nuclear Energy Americas, LLC (GEH) submitted Licensing Topical Report NEDC-33934P/NEDO-33934, Revision 0, BWRX-300 Safety Strategy to the U.S. Nuclear Regulatory Commission (NRC) for review and approval. The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this topical report. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to begin its detailed technical review.

Attached to this email youll find the completed form for the NRC staffs topical report completeness determination. This form provides the determination, key milestone dates for the review, and an estimate of review hours. The review schedule assumes a 30-day response to the NRC staffs request for additional information (RAIs). The dates and resource estimates could change due to several factors, such as the timeframe for resolution of technical issues, or other unanticipated factors.

The NRC staff has determined that the subject topical report is acceptable for review.

However, the staff notes that this is a generic framework methodology topical report which does not seek approval of the BWRX-300 design features. While the topical report contains sufficient information to support a detailed review, in some areas it does not include detailed design information or safety analyses that would be needed for the staff to make final safety findings in these areas. Any potential staff approval of the methodology would likely be a conditional approval for which the acceptability of the approach will be contingent upon the staffs review of the application of the methodology and specific design details expected to be available in future licensing applications for the BWRX-300. Therefore, any potential staff approval of the methodology will likely include limitations and conditions on the application of this LTR and will specify the additional information needed. Several of these areas were noted in the NRC staffs readiness assessment observations discussed in its meeting with GEH on February 28, 2024. The staff identified some additional areas during the acceptance review that will require additional information or clarification such as, but not limited to, the need for clarity on how complex sequences are selected in a repeatable and transparent manner for evaluation without numerical ranking with consideration of uncertainty and key assumptions, and additional details on the event sequence frequency determination. Some of the needed additional information or clarifications noted in the NRC staffs readiness assessment observations remain as areas

to be addressed and will also be topics for the staffs future interactions with GEH or sent as RAIs.
