Dear Mr. Cullison:
The Nuclear Energy Institute (NEI)1, on behalf of its fuel cycle facility (FCF) members, appreciates the opportunity to comment on the information collection renewal titled Information Collection: Material Control and Accounting of Special Nuclear Material (Docket ID NRC-2023-0099). The regulations in 10 CFR Part 74 establish requirements for material control and accounting of special nuclear material (SNM) authorized by NRC for use and possession by licensees regulated pursuant to 10 CFR Part 70. Based on our review of the Federal Register Notice issued February 16, 2024, [89FR12383] we offer the following comment for NRCs consideration.
Item 9 in the FRN states: The estimated number of hours needed annually to comply with the information collection requirement or request: 9,439 hours0.00508 days <br />0.122 hours <br />7.258598e-4 weeks <br />1.670395e-4 months <br /> (939 reporting + 8,500 recordkeeping). The FRN does not state whether this hour estimate is per licensee or intended to represent the hour impact for the entire industry. If the former, the estimate is correct. In that, current Part 70 fuel facility licensees agree that, 9,439 hours0.00508 days <br />0.122 hours <br />7.258598e-4 weeks <br />1.670395e-4 months <br /> generally represents their individual facility resource expenditure to comply with Part 74. On the other hand, if NRC is using this number to represent the impact to the entire industry, it is not correct.
