Docket Nos. 50-275 LR-2 50-323 LR-2 NRC STAFF NOTICE OF PREFERENCES REGARDING ORAL ARGUMENT Pursuant to the Atomic Safety and Licensing Boards Initial Prehearing Order,1 the U.S.

Nuclear Regulatory Commission Staff hereby notifies the Board of its preferences regarding a potential oral argument on standing and contention admissibility in the NRCs adjudicatory proceeding regarding Pacific Gas and Electric Companys (PG&Es) license renewal application for Diablo Canyon Nuclear Power Plant, Units 1 and 2.

In terms of the date for a potential oral argument, the Board noted that it was considering April 23, 24, 25, 30, or May 1, 2.2 NRC Staff Counsel has scheduled mandatory training for attorneys at the NRCs Technical Training Center in Tennessee from April 22-26, 2024, and would be unavailable for an in-person oral argument on those dates. Therefore, of the dates identified by the Board, the NRC Staff prefers April 30, May 1, or May 2.

In terms of the location for a potential oral argument, the Board noted that it was considering two in-person options, either: (1) in the Boards Hearing Room (at the NRC Headquarters near Washington D.C.), with the argument also webcast, or (2) at a location near 1 Atomic Safety and Licensing Board Memorandum and Order (Initial Prehearing Order) (Mar.

the Diablo Canyon Nuclear Power Plant.3 The NRC Staff has no preference regarding location.

San Luis Obispo Mothers for Peace, Friends of the Earth, and Environmental Working Group stated that they prefer the location near Diablo Canyon Nuclear Power Plant because, in part, the oral argument may be the NRCs only adjudication-related public meeting regarding PG&Es license renewal application to be held in the local area.4 Nonetheless, the NRC Staff notes that there was an in-person public scoping meeting regarding the license renewal application in San Luis Obispo on February 8, 20245 and that the NRC Staff may also hold an in-person public meeting on the draft supplemental environmental impact statement when it is issued.6 Respectfully submitted,
